Camber Property Group Announces Renovation Program For Two Affordable Housing Projects In The Bronx

Following Camber Property Group’s acquisition of Morris Heights Mews and Trinity Apartments, two deeply affordable housing properties in The Bronx, the company has announced comprehensive renovation programs that will improve energy efficiency and resident comfort.

Camber has also committed to preserving and extending affordability at both housing projects.

Earlier this month, Camber closed on Morris Heights Mews, a three building, 111-unit Project Based Section 8 complex located at 1695 Grand Avenue in the Morris Heights section of The Bronx. The company committed to undertake roughly $3 million in improvements at the complex, including energy efficiency upgrades, façade and roof enhancements, repairs to building systems including the elevator and boiler, and repairs to residential units. A new 20-year Section 8 contract was also signed at closing for the property.

SVN Affordable brokered the Morris Heights Mews transaction. Community Preservation Corporation will partner with Camber to complete the facility upgrades.

In December 2022, Camber closed on Trinity Apartments, a 76-unit, 100-percent Project Based Section 8 building located at 2105 Daly Avenue in the borough’s West Farms neighborhood. The total development cost for the project was $27.4 million, financed with a $18.3 million loan from Freddie Mac via Walker and Dunlop, and $9 million of private equity capital. Following the closing, Camber will implement energy efficiency and common area improvements at the building.

Sixteen Members Of A Washington Heights Narcotics Crew Charged With Narcotics And Firearms Offenses

 

 Damian Williams, the United States Attorney for the Southern District of New York, Ivan J. Arvelo, the Special Agent-in-Charge of the New York Field Office of Homeland Security Investigations (“HSI”), Keechant Sewell, the Commissioner of the New York City Police Department (“NYPD”), and Patrick Freaney, Special Agent in Charge of the New York Field Office of the United States Secret Service (“USSS”), announced the unsealing of an Indictment today charging 16 members of a Washington Heights-based narcotics trafficking organization with conspiring to distribute narcotics in New York and with possessing firearms in furtherance of the narcotics trafficking conspiracy.  ALEXANDER FRANCISCO, a/k/a “Javy,” ARISTIDES RAMIREZ, a/k/a “AR,” DAVID GLOVER, ALEX GARCIA, a/k/a “AG,” ANEUDY ALVARADO, a/k/a “Smiley,” JERIEL ABREU, a/k/a “Jerry Gunz,” LAZARETH PAULINO, a/k/a “Laz,” JOAN MERCEDES, a/k/a “Saul,” and ENMANUEL LIRIANO, a/k/a “Chubster,” a/k/a “Eman,” were arrested today and presented before United States Magistrate Judge Sarah L. Cave.  CHRISTOPHER SANTOS, a/k/a “Casper,” was arrested previously in this matter.  ALVIN EUSEBIO, a/k/a “Goo,” EDWARD RODRIGUEZ, and JAWAN MILLS, a/k/a “JD,” were already in custody in other jurisdictions.  RAY EDUARDO, JONATHAN RODRIGUEZ, a/k/a “JR,” and EDDY CAMINERO, a/k/a “Malibu,” remain at large.  This case is assigned to United States District Judge Gregory H. Woods.

U.S. Attorney Damian Williams said: “As alleged in the Indictment, these defendants injected substantial quantities of narcotics into the community, putting dangerous drugs on the streets and putting lives in danger.  Thanks to the extraordinary work of our partners at NYPD, HSI, and the USSS, the defendants now face federal charges for their crimes.”

HSI Special Agent in Charge Ivan J. Arvelo said: “The success of today’s operation represents another important stride in our ongoing effort to combat narcotics trafficking and firearms use in New York City and also reinforces our commitment to our law enforcement partners.  I’m proud of our agents’ extensive investigative work to apprehend these members from the Washington Heights-based 174th Street Crew - a crew who are known to traffic narcotics and possess firearms.  HSI will continue to work closely with the New York City Police Department, the U.S. Secret Service, and all of our local, state, and federal law enforcement partners to dismantle these dangerous criminal enterprises and hold their members accountable for their blatant disregard for the law.”

NYPD Commissioner Keechant L. Sewell said: “This investigation, involving several law enforcement agencies across multiple jurisdictions, is a perfect example of how focused collaboration makes us all safer.  The illegal drug trade wreaks havoc in our most vulnerable communities, and our job is to ensure that anyone who peddles this poison be brought to justice swiftly and successfully.  This dangerous and exploitative criminal behavior will never be tolerated in our city, and I want to thank the U.S. Attorney’s Office for the Southern District of New York, Homeland Security Investigations New York, the New York Field Office of the United States Secret Service, and everyone else who worked on this case and made New York City safer for all the people we serve.”

As alleged in the Indictment unsealed today in Manhattan federal court and in other court papers and proceedings:[1]

From at least in or about 2019, up to and including January 2023, in the Southern District of New York and elsewhere, ALEXANDER FRANCISCO, ARISTIDES RAMIREZ, DAVID GLOVER, ALVIN EUSEBIO, ALEX GARCIA, ANEUDY ALVARADO, EDWARD RODRIGUEZ, JERIEL ABREU, RAY EDUARDO, LAZARETH PAULINO, JONATHAN RODRIGUEZ, JAWAN MILLS, JOAN MERCEDES, EDDY CAMINERO, ENMANUEL LIRIANO, and CHRISTOPHER SANTOS operated a large-scale narcotics trafficking organization in, among other places, New York City.  This organization (the “174th Street Crew”) operated principally in the Washington Heights neighborhood of Manhattan between West 174th and West 175th Streets and Amsterdam and Audubon Avenues (the “Set”).  Within the Set, the 174th Street Crew conducted narcotics trafficking on the street and from multiple store fronts.  The 174th Street Crew ran an organized, sophisticated narcotics trafficking operation that is best described as a street pharmacy, which sold a variety of narcotics, both illicit and prescription, to its customers, including methamphetamine, cocaine, heroin, crack cocaine, fentanyl, oxycodone, Xanax, and marijuana.  The crew operated on the Set at all hours, and its members were assigned to work in designated shifts.  Managers ensured that the Set was properly staffed for narcotics distribution and fined and disciplined members who missed work or demanded proof of illness (such as a doctor’s note or picture of a positive COVID-19 test).

Members and managers of the 174th Street Crew frequently carried and used firearms, including to protect the stash of narcotics belonging to the 174th Street Crew.  In addition to one firearm seized today, twice in the past 13 months – in December 2021 and August 2022 – NYPD officers recovered handguns possessed by 174th Street Crew members holding stashes of narcotics on the Set.

During simultaneous arrests and searches conducted today in New Jersey and New York, law enforcement agents seized quantities of methamphetamine, cocaine, heroin, oxycodone, Percocet, and suboxone, as well as large sums of cash.

All defendants are charged with conspiracy to distribute and possess with intent to distribute (i) 500 grams and more of mixtures and substances containing a detectable amount of methamphetamine, its salts, isomers, or salts of its isomers; (ii) 500 grams and more of mixtures and substances containing a detectable amount of cocaine; (iii) mixtures and substances containing a detectable amount of heroin; (iv) mixtures and substances containing a detectable amount of fentanyl; and (v) mixtures and substances containing a detectable amount of oxycodone.  This charge carries a mandatory minimum sentence of 10 years in prison and a maximum sentence of life in prison.  All defendants are also charged with possessing firearms in furtherance of the narcotics trafficking offense charged in the Indictment, which carries a mandatory minimum sentence of five years in prison, which must be served consecutively to any other sentence imposed, and a maximum sentence of life in prison.

The minimum and maximum potential sentences in this case are prescribed by Congress and are provided here for informational purposes only, as any sentencing of a defendants would be determined by the judge.

Mr. Williams praised the outstanding investigative work of the Department of Homeland Security, Homeland Security Investigations, the New York City Police Department, the U.S. Secret Service, and the Organized Crime Drug Enforcement Task Forces (“OCDETF”).  This prosecution is part of an OCDETF operation.  OCDETF identifies, disrupts, and dismantles the highest-level criminal organizations that threaten the United States using a prosecutor-led, intelligence-driven, multi-agency approach.  Additional information about the OCDETF Program can be found at https://www.justice.gov/OCDETF.

The charges contained in the Indictment are merely accusations and the defendants are presumed innocent unless and until proven guilty.

Grand Central Madison Enables the First Direct Transfers Between the LIRR and Metro-North Railroad

 Governor Kathy Hochul and MTA Chair and CEO Janno Lieber today rode the inaugural Long Island Rail Road train to Grand Central Madison, which arrived at the terminal platform at 11:07 a.m. The train was the first of Grand Central Direct trains now operating between Jamaica and Grand Central Madison between 6:15 a.m. and 8:00 p.m. on weekdays and between 7:00 a.m. and 11:00 p.m. on weekends. Trains are running every 30 minutes in both directions during weekday midday periods as well as on weekends, and once per hour during peak periods - arriving in Grand Central between 6:30 a.m. and 10:00 a.m. and departing between 4:30 p.m. and 7:30 p.m.

"Grand Central Madison is a game changer for New Yorkers, and I look forward to welcoming Long Island commuters to our tremendous new terminal," Governor Hochul said. "Infrastructure is all about connections, and this project is an extraordinary step forward to better connect millions of New Yorkers with their homes, their families and their jobs."

During this initial period, the LIRR has customer ambassadors on the Grand Central Madison concourse to greet customers and offer information about the new space. LIRR customers to Grand Central Madison can use their Penn Station tickets, as Penn Station and Grand Central Madison are in the same fare zone. The special Grand Central Direct service will conclude with the initiation of full train service mirroring what was put forward in draft schedules published last June. To enable travel planning, the MTA will provide at least three weeks notice before new, full schedules go into effect.

Grand Central Madison doubles LIRR capacity into Manhattan. In conjunction with the completion of a third track on the LIRR Main Line, the new terminal enables reverse commuting options that were not previously possible. For LIRR customers who work on the east side of Manhattan, this new terminal is expected to save 40 minutes a day of commute time round trip.

The terminal also provides seamless connectivity through the MTA region, with both commuter railroads and the New York City Subway all in one building for the first time. The expansion of CityTicket will provide an additional travel option to Queens communities served by the LIRR, providing easier access to job opportunities. The impending introduction of the Combo Ticket will give New Yorkers, and those visiting New York, more travel options than ever to get to Long Island, the Hudson Valley, or Connecticut from the five boroughs. Customers in Metro-North Railroad territory for example will now have an one-ticket ride to JFK Airport.

The beginning of service now enables the possibility of transferring directly between the LIRR and Metro-North Railroad. To encourage riders from each railroad to try the other, when full LIRR service begins to Grand Central Madison, the MTA will introduce the "Combo Ticket" - a single ticket that enables customers to travel between Long Island, Manhattan's northern suburbs and Connecticut all with one fare.

The Combo Ticket will enable riders to buy a LIRR ticket in Huntington for a trip to White Plains or a Metro-North ticket in Poughkeepsie for a trip to Montauk. Riders choose their origin station with Grand Central as their destination and pay the regular fare plus a flat rate of eight dollars for a continuing trip to any destination on the other railroad. The Combo Ticket will go into effect once the Grand Central Madison timetables are implemented.

The Grand Central Madison systemwide timetables are expected to include 274 more trains each weekday than currently operate, a historic 41 percent service increase made possible in part by the completion on October 3 of a new 9.8-mile Main Line third between Floral Park and Hicksville. The timetables represent the first comprehensive rewrite of LIRR schedules in decades and the MTA encourages all riders, no matter when or where they travel, to review their options on the TrainTime app or review the LIRR's service overview to see new options for their travel.

Grand Central Madison and Main Line Third Track are part of an unprecedented $17.7 billion investment to transform and modernize the Long Island Rail Road with 100 projects throughout the system including construction of a more spacious LIRR Concourse at Penn Station with a new entrance at 33rd Street and Seventh Avenue, renewal and upgrading of 36 stations and 17 bridges, elimination of eight at-grade railroad crossings, activation of the Positive Train Control safety system, installation of 13 miles of second track between Farmingdale and Ronkonkoma, upgrades to 15 electrical substations, parking capacity increases, and yard expansions.

Additionally, following the opening of Moynihan Train Hall in 2021, the MTA, together with Empire State Development, NJ TRANSIT and Amtrak, is transforming Penn Station into a world-class, single-level terminal with abundant natural light, high ceilings, increased access to platforms, and enhanced wayfinding

The LIRR published draft timetables showing Grand Central Madison service on June 2 for public review and held six virtual information sessions and public meetings between June 23 and August 11 to gather public feedback.

MANHATTAN MAN SENTENCED TO 5 YEARS IN PRISON FOR PULLING GUN ON INDIVIDUAL AT PLAYGROUND

 

Defendant Found Guilty by Jury of Second-Degree Criminal Possession of a Weapon

 Bronx District Attorney Darcel D. Clark today announced that a Manhattan man has been sentenced to five years in prison after a jury convicted him of weapon possession for displaying a loaded gun in a playground.

 District Attorney Clark said, “The defendant threatened the safety of the community, striking fear in people who use the Marble Hill Playground as a place to take their family. The jury in this case was able to review the evidence and came back with a guilty verdict. We are sending a clear message that we are not tolerating gun violence in the Bronx.”

 District Attorney Clark said the defendant, Charles Cherry, 34, of Riverside Drive, Manhattan, was sentenced to five years in prison and five years of post-release supervision today by Bronx Supreme Court Justice Steven Hornstein. The defendant was found guilty of one count of second-degree Criminal Possession of a Weapon on November 15, 2022 after a jury trial.

 According to the investigation, on August 28, 2020, the defendant was arguing with another man at the Marble Hill Playground. Cherry left and returned and pointed the gun at the other individual. The NYPD was notified about the altercation and an officer arrived at the playground and pursued Cherry, who ran behind a building at 5250 Broadway. At the location, police recovered a loaded 9-mm pistol, which had DNA on it belonging to Cherry. Nearby surveillance video from a storage facility also captured Cherry on camera.

 District Attorney Clark thanked NYPD Officer Michael Johnson of the 50th Precinct, NYPD Detective James Haskell of the NYPD Police Laboratory, Detective Luke Maddock of the Violent Crime Squad, Officer Christopher Multari, Evidence Collection Team and Elizabeth Valle, Criminalist of the Office of the Chief Medical Examiner for their assistance.

Attorneys And Associate Of Immigration Law Firm Plead Guilty To Participating In Asylum Fraud Scheme

 

Defendants Prepared Fraudulent Asylum Applications and Affidavits, Coached Clients to Lie Under Oath During Immigration Proceedings

 Damian Williams, the United States Attorney for the Southern District of New York, announced that ILONA DZHAMGAROVA, ARTHUR ARCADIAN, and IGOR REZNIK have each pled guilty to conspiracy to commit immigration fraud.  DZHAMGAROVA and ARCADIAN pled guilty today, and REZNIK pled guilty on August 24, 2022, each before U.S. District Court Judge Mary Kay Vyskocil.

U.S. Attorney Damian Williams said: “The defendants — a husband and wife team of licensed immigration attorneys and a writer who worked with them — invented offensive lies to cheat our country’s asylum process, which is meant to protect vulnerable people who legitimately fear persecution because of their race, religion, political beliefs, or sexual orientation.  When attorneys cynically exploit those fears for financial gain by pedaling false claims and coaching clients to lie under oath, they abuse the trust placed in them and make a mockery of the asylum system.  With their guilty pleas, the defendants are being held accountable for their serious crimes.”

According to the Indictment against DZHAMGAROVA, ARCADIAN, and REZNIK, other documents filed in this case, and statements made in open court:

Between November 2018 and December 2021, ILONA DZHAMGAROVA, an immigration attorney, ran the Dzhamgarova Firm, an immigration services firm based in Brooklyn, New York.  The Dzhamgarova Firm worked with clients — primarily aliens from Russia and the Commonwealth of Independent States — seeking visas, asylum, citizenship, and other forms of legal status in the United States.  Among other things, the Dzhamgarova Firm advised certain of its clients regarding the manner in which they were most likely to obtain asylum in this country, fully understanding that those clients did not legitimately qualify for asylum.  The firm also prepared and submitted to United States Citizenship and Immigration Services (“USCIS”) clients’ fraudulent Form I-589 asylum applications, asylum affidavits — statements of an asylum applicant’s personal history and claimed basis for asylum, often including allegations of past persecution — and related supporting documentation.  Members and associates of the firm also coached certain clients to lie under oath during interviews conducted by USCIS Asylum Officers and provided legal representation to their clients during various immigration proceedings.

Among other things, DZHAMGAROVA advised clients to seek asylum by falsely claiming that they were members of the lesbian, gay, bisexual, transgender, and queer community who suffered persecution in their native countries, when DZHAMGAROVA fully understood that these clients were not members of that community and suffered no such persecution.  Additionally, DZHAMGAROVA and her husband, ARTHUR ARCADIAN, also an attorney, prepared and submitted clients’ fraudulent asylum applications and affidavits to USCIS, under penalty of perjury, fully understanding that these documents at times contained material falsehoods.  DZHAMGAROVA, ARCADIAN, and REZNIK also coached certain clients to lie in asylum interviews conducted by USCIS asylum officers and represented these clients as they lied under oath during immigration proceedings.

The Dzhamgarova Firm also employed writers, including IGOR REZNIK, who knowingly concocted and drafted clients’ fraudulent asylum affidavits so that they could be submitted as part of clients’ asylum applications.  These affidavits, which were designed to support clients’ persecution claims, conveyed narrations of clients’ personal histories that were filled with falsehoods, including events and incidents of alleged persecution that were completely made up by REZNIK.  

DZHAMGAROVA, 46, ARCADIAN, 44, both of Brooklyn, New York, and REZNIK, 41, of New York, New York, each pled guilty to one count of conspiring to commit immigration fraud and each face a maximum of five years in prison. 

The maximum potential sentence in this case is prescribed by Congress and is provided here for informational purposes only, as any sentencing of the defendants will be determined by a judge.  DZHAMGAROVA and ARCADIAN are scheduled to be sentenced by U.S. District Court Judge Mary Kay Vyskocil on May 31, 2023.  REZNIK is scheduled to be sentenced by Judge Vyskocil on May 5, 2023. 

Mr. Williams praised the outstanding investigative work of the Federal Bureau of Investigation’s New York Eurasian Organized Crime Task Force, USCIS’s New York Asylum Office and Fraud Detection and National Security Unit, and Homeland Security Investigations.  Mr. Williams further thanked United States Customs and Border Protection for its assistance.

Governor Encourages New Yorkers to Keep Using the Tools to Protect Against and Treat COVID-19: Vaccines, Boosters, Testing and Treatment

 Governor Kathy Hochul today updated New Yorkers on the state's progress combating COVID-19 and outlined basic steps they can take to protect against the spread of viral respiratory infections that become more common in the winter season.  

"I urge all New Yorkers to remain vigilant and continue to use all available tools to keep themselves, their loved ones and their communities safe and healthy," Governor Hochul said. "Be sure to stay up to date on vaccine doses, and test before gatherings or travel. If you test positive, talk to your doctor about potential treatment options." 

Governor Hochul is urging New Yorkers to take common prevention measures — like staying up to date on vaccines and practicing proper hygiene — to protect from the flu and COVID-19 and reduce the patient burden on local hospitals. The Governor reiterated these basic steps when she updated New Yorkers on the state's winter health preparedness efforts last month.  

Recently, the New York State Department of Health announced that the XBB.1.5. variant is now the most dominant strain in New York, accounting for more than 50 percent of COVID-19 infections statewide. Emerging at a time when both COVID-19 and flu cases remain high, early data indicates that XBB.1.5. is more transmissible than other circulating variants, though there is not yet clear evidence of significant changes to virulence or severity of disease.  

The New York State Department of Health's weekly flu surveillance report for the week ending January 14, shows influenza remaining widespread throughout the state for a fifteenth consecutive week, with a total of 300,907 positive cases across all 62 counties reported to date. The report found that confirmed cases statewide dropped 50 percent, while overall hospitalizations were down 52 percent from the previous week, with the week, at 798 hospitalizations across the state. 

Additionally, there were 13 outbreaks in acute care and long-term care facilities, the report determined. There were two additional pediatric deaths, leaving the total at eight statewide. 

With flu season continuing and infections remaining widespread, Governor Hochul encourages all New Yorkers to get their annual flu vaccine. The flu virus and the virus that causes COVID-19 are both circulating, so getting vaccinated against both is the best way to stay healthy and to avoid added stress to the health care system.  

The Health Department is continuing its annual public education campaign, reminding adults and parents to get both flu and COVID-19 shots for themselves and children 6 months and older. For information about flu vaccine clinics, contact the local health department or visit vaccines.gov/find-vaccines/

Governor Hochul also continues to urge New Yorkers to get their bivalent COVID-19 vaccine boosters. Last month, the New York State Department of Health announced new guidance for bivalent COVID-19 booster doses, which are now available for eligible children down to 6 months of age.  

The updated boosters are the first to be targeted to the original virus strain and recently circulating variants and are recommended for young New Yorkers and all those eligible. To schedule an appointment for a booster, New Yorkers should contact their local pharmacy, county health department, or healthcare provider; visit vaccines.gov; text their ZIP code to 438829, or call 1-800-232-0233 to find nearby locations.

The Health Electronic Response Data System is a NYS DOH data source that collects confirmed daily death data as reported by hospitals, nursing homes and adult care facilities only.   

Important Note: Effective Monday, April 4, the federal Department of Health and Human Services is no longer requiring testing facilities that use COVID-19 rapid antigen tests to report negative results. As a result, New York State's percent positive metric will be computed using only lab-reported PCR results. Positive antigen tests will still be reported to New York State and reporting of new daily cases and cases per 100k will continue to include both PCR and antigen tests. Due to this change and other factors, including changes in testing practices, the most reliable metric to measure virus impact on a community is the case per 100,000 data — not percent positivity.
