Governor Hochul Releases New York State Cybersecurity Grant Plan

Nearly $6 Million in Federal Funding Will Be Utilized to Help Local Entities Reduce Cyber Risk and Build Cyber Resiliency

State to Use Infrastructure Act Grant Funding to Procure Multi-Factor Authentication, Cybersecurity Scholarships and Cybersecurity Training Resources on Behalf of Local Partners

Online Interest Form Released to Eligible Entities to Indicate Interest in Receiving Services Provided Through This Program

Governor Kathy Hochul released the New York State Cybersecurity Grant Plan, which details a whole-of-state approach to reduce cyber risk and build cyber resiliency in local governments statewide. Through the utilization of nearly $6 million in funding through the federal State and Local Cybersecurity Grant Program, this grant program will expand access to cybersecurity information, tools, resources, and services so that public sector entities in New York have access to the most sophisticated cyber defenses. Given the funding available, New York will use its economy of scale purchasing power to directly procure and deliver best-in-brand software, hardware, and services to eligible entities.

“A cyberattack can halt an entire community, and it’s essential that local governments have the resources and information needed to protect themselves and quickly respond to a cyber threat,” Governor Hochul said. “This funding will provide tools to help municipalities secure critical infrastructure to protect New Yorkers and reduce cyber risks.”

As part of the federal Infrastructure Investment and Jobs Act of 2021, Congress established the State and Local Cybersecurity Grant Program (SLCGP) to award funding to each state to help eligible entities address cybersecurity risks and threats to information systems owned or operated by or on behalf of State, local, tribal, and territorial governments. The SLCGP FY2022 funding allocation for New York is $5,810,605, and at least 80 percent of the funds will be allocated to goods and services for local government entities, with at least 25 percent of that allocated to entities in rural areas.

To ensure the maximum number of New York entities can benefit from the limited SLCGP funds, New York will directly procure software, hardware, and services for delivery to eligible entities. During the program’s first year, New York State is focusing on shared services initiatives to help local government entities build a baseline level of cybersecurity. These initiatives are:

  • Multi-Factor Authentication (MFA): MFA is a method to authenticate a user that requires them to provide two or more verification factors so they can gain access to a resource. New York will provide hardware and/or software tokens and professional services that eligible entities can use to implement MFA in their technology environments.
  • Cybersecurity Certification Scholarship: New York will provide scholarships for select employees from eligible entities who currently have roles or responsibilities related to information technology, information security, cybersecurity, data privacy, and/or data security to achieve an industry-recognized cybersecurity certification.
  • Cybersecurity Awareness Training: New York will provide an online cybersecurity awareness training for eligible entities for their employees.

Eligible entities can indicate their interest to participate in one or more of the shared services offerings by completing the SLCGP Interest Form. Responses to this form will help the state appropriately plan to address statewide need utilizing FY2022 funding in Year 1 of the program. A formal application process will commence later this year. Application information will be made available on the Division of Homeland Security and Emergency Services’ Grant Programs webpage.

The release of New York’s Cybersecurity Grant Plan is the latest step taken by Governor Hochul to strengthen the state’s cyber defenses and ensure the state and its local partners are prepared as digital threats continue to increase.

In August 2023, Governor Hochul released the first-ever New York State Cybersecurity Strategy that set forth an approach to cybersecurity and resilience based on the principles of unification, resilience, and preparedness. The Cybersecurity Strategy’s five pillars –Operate, Collaborate, Regulate, Communicate, and Grow– informed the development of the Grant Plan and are reflected throughout. As an administrative requirement of the SLCGP, the Grant Plan not only represents another facet of New York State’s extensive portfolio of cybersecurity measures that builds cybersecurity maturity among our critical institutions, but it is also an iterative effort designed to respond to the shifting needs of our state.

Under Governor Hochul's leadership, New York also launched a nation-leading program to provide cybersecurity services to county and local government entities, covering more than 76,000 government-owned computers across the state, and expanded the state’s law enforcement cyber capabilities by growing the Computer Crimes Unit, Cyber Analysis Unit, and Internet Crimes Against Children Center at the New York State Police. In 2024, Governor Hochul is expanding the Shared Services Program by extending eligibility for the endpoint detection and response shared service and adding an additional capability, attack surface management, to the Shared Services Program. To further protect New York's critical infrastructure, Governor Hochul has also proposed new hospital cybersecurity regulations and signed landmark legislation to protect New York's energy grid from cyberattacks. As cyber threats rapidly evolve, New York remains at the cutting edge of cybersecurity policy and continues to strengthen defenses across the public and private sectors.


Oil and Gas Trader Convicted for Role in Foreign Bribery and Money Laundering Scheme

 

A federal jury in Brooklyn convicted an oil and gas trader for his role in a scheme to bribe Ecuadorean and Mexican government officials and to launder money to secure contracts worth hundreds of millions of dollars for his then-employer, Vitol Inc. (Vitol), the U.S. affiliate of the largest independent energy trading firm in the world.

According to court documents and evidence presented at trial, Javier Aguilar, 49, of Houston, paid more than $1 million in bribes to officials of Petroecuador, the Ecuadorean state-owned oil and gas company, and PEMEX Procurement International (PPI), a subsidiary of PEMEX, the Mexican state-owned oil and gas company, to obtain lucrative contracts for Vitol.

“Javier Aguilar bribed officials at state-owned oil and gas companies in Ecuador and Mexico using shell companies and sham invoices to obtain business for Vitol Inc., where he worked as an oil and gas trader,” said Acting Assistant Attorney General Nicole M. Argentieri of the Justice Department’s Criminal Division. “With today’s verdict, the jury has held him accountable for his role in a sophisticated bribery and money laundering scheme that netted Vitol hundreds of millions of dollars in contracts. Foreign bribery erodes the rule of law, disadvantages honest companies, and emboldens corrupt government officials. The Criminal Division will continue to vigorously pursue wrongdoers who bribe foreign officials and bring them to justice.”

“This verdict represents another victory in this office’s commitment to rooting out corruption in the international marketplace,” said U.S. Attorney Breon Peace for the Eastern District of New York. “The defendant and his co-conspirators sought to enrich themselves through criminal backroom deals. The people of Ecuador and Mexico deserved better and companies that play by the rules should know that the process is not rigged. The Justice Department and my office will continue to prioritize holding to account individuals who enrich themselves through bribery.” 

“As demonstrated by this case, the Foreign Corrupt Practices Act has a long reach,” said Special Agent in Charge Jeffrey B. Veltri of the FBI Miami Field Office. “Aguilar’s egregious attempt to get away with bribing officials in Ecuador and Mexico failed, and he will now face tough penalties. I want to commend our partners in the Justice Department’s Criminal Division and at the U.S. Attorney’s Office for the Eastern District of New York for their close cooperation on this case.”

The trial evidence showed that, between 2015 and 2020, Aguilar was a trader in Vitol’s Houston office. As a part of the scheme, Aguilar and his co-conspirators agreed to bribe senior Ecuadorian officials to obtain a $300 million contract to purchase fuel oil for Vitol. Aguilar and his co-conspirators used another Middle Eastern state-owned entity to circumvent Petroecuador’s restrictions on contracts with private companies. In return for the promise and payments of bribes, the Ecuadorian officials then ensured that the Middle Eastern state-owned entity and Vitol were awarded the contract. Following the 2017 Ecuadorean presidential election, the officials who received bribes were replaced by new senior officials. To ensure continuity under the then-existing fuel oil contract and to obtain additional business, Aguilar and his co-conspirators agreed to bribe them as well.

To conceal the scheme, Aguilar and his co-conspirators used a series of fake contracts, sham invoices, and shell entities incorporated in Curacao, Panama, and Cayman Islands. Aguilar also used alias email accounts to communicate with his co-conspirators rather than his Vitol email.

The evidence at trial also demonstrated that Aguilar used the same system of shell entities and sham invoices to launder bribe payments to two officials at PPI. In total, Aguilar paid approximately $600,000 in bribes to these officials to obtain numerous contracts for Vitol to supply hundreds of millions of dollars of ethane gas to PEMEX.   

The jury convicted Aguilar of conspiracy to violate the Foreign Corrupt Practices Act (FCPA), violating the FCPA, and conspiracy to commit money laundering. He faces a maximum penalty of five years in prison on each of the FCPA counts and 20 years in prison on the money laundering count. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

Seven of Aguilar’s co-conspirators have pleaded guilty to their roles in the scheme and are awaiting sentencing. These individuals have agreed to forfeit more than $63 million. 

In December 2020, Vitol admitted to bribing officials in Ecuador, Mexico, and Brazil in violation of the anti-bribery provisions of the FCPA. Vitol entered into a deferred prosecution agreement with the Criminal Division’s Fraud Section and Money Laundering and Asset Recovery Section (MLARS) and the U.S. Attorney’s Office for the Eastern District of New York. As a part of the resolution, Vitol agreed to pay a combined $135 million in penalties as part of a coordinated resolution with the Justice Department, the Commodity Futures Trading Commission, and authorities in Brazil.

FBI Miami’s International Corruption Squad investigated the case.

Hunter Smith of MLARS, and Assistant U.S. Attorneys Jonathan P. Lax, Matthew R. Galeotti, and Nick M. Axelrod for the Eastern District of New York are prosecuting the case. The MLARS Special Financial Investigations Unit and Justice Department’s Office of International Affairs also provided substantial assistance.

MAYOR ADAMS, NYC HEALTH + HOSPITALS ANNOUNCE FREE TAX PREP SERVICES FOR NEW YORKERS

 

With Tax Season Underway, In-Person and Virtual Tax Preparation Services Will Be Available at City Public Hospitals in Various Languages

New York City Mayor Eric Adams and NYC Health + Hospitals announced free, in-person, and virtual tax preparation services for New Yorkers as part of the New York City Department of Consumer and Worker Protection’s (DCWP) NYC Free Tax Prep initiative. In partnership with BronxWorks, Grow Brooklyn, Urban Upbound, and Code for America’s GetYourRefund initiative, free tax preparation is available for New Yorkers who earn $85,000 or less annually and file as a family, or those who earn $59,000 or less annually and file as an individual or couple without dependents. Select NYC Health + Hospitals sites offer support in Spanish, Chinese, and Bengali, and virtual tax preparation is available in Spanish as well.

 

“Every day, we work to make this city more livable for working-class New Yorkers, and by offering free tax preparation at NYC Health + Hospitals sites, we are again delivering for families across the five boroughs,” said Mayor Adams. “Services are available online, in-person, and in multiple languages, making it easy for families to file their taxes and keep money in their pockets. We went to Albany to secure the first increase in the city’s Earned Income Tax Credit in 20 years, and we are thrilled to offer New Yorkers NYC Free Tax Prep to help them receive their fair share this tax season.”

 

For in-person services, individuals should schedule an appointment in advance and bring identification and proof of income. For virtual services, individuals can upload their documents and meet virtually with a tax preparer to review their tax return before submission. A full checklist of the documents needed to file taxes is available online.

NYC Free Tax Prep provides free, professional tax preparation that can help New Yorkers keep their full refund, including valuable tax credits, like the recently enhanced New York City Earned Income Tax Credit. NYC Free Tax Prep Services include:

  • In-Person Tax Preparation: At in-person tax prep sites, knowledgeable Internal Revenue Service (IRS) certified Volunteer Income Tax Assistance (VITA) or Tax Counseling for the Elderly (TCE) volunteer preparers help filers complete an accurate tax return. More than 130 sites across the city will be open throughout the season.
  • Drop-Off Service: With drop-off service, filers can drop off their tax documents and pick up the completed return later.
  • Virtual Tax Preparation: Virtual Tax Preparation is an online service where an IRS-certified VITA or TCE volunteer preparer will video conference with filers to help prepare their tax return using a secure digital system. Filers can submit photos or scans of tax documents to the preparer, confirm their identity, and complete their return by video call with a preparer. Filers will need access to a computer, tablet, or smartphone; a stable internet connection; and the ability to download secure video conference software.
  • Assisted Self-Preparation: Assisted Self-Preparation allows filers to complete their tax return online on their own, and an IRS-certified VITA/TCE volunteer preparer will be available by phone or email to answer questions. Filers will need access to a computer, tablet, or smartphone; a stable internet connection; an email address; and their 2022 adjusted gross income or self-select PIN.

NYC Free Tax Prep Services are available now at over 130 VITA and TCE sites around the city.  The IRS will accept returns through April 15, 2024. New Yorkers can call 311 or visit the NYC Free Tax Prep website and use DCWP’s interactive map to search for the most convenient free tax site near them.

Laborers Recruit Apprentices

The Local 1010 Pavers Joint Apprenticeship Committee, will conduct a limited recruitment from March 25, 2024 through April 5, 2024 for 12 Skilled Construction Craft Laborer apprentices, the New York State Department of Labor announced today.

Applications must be obtained and submitted in person at the Local 1010 Pavers JATC, 17-20 Whitestone Expressway, Suite 302, Whitestone NY 11357, from 8:00 a.m. to 4:00 p.m., Monday through Friday, excluding legal holidays, during the recruitment period. This is a limited-application recruitment. Only 80 applications will be distributed, on a first-come, first-serve basis. The recruitment will be offered for 10 business days or until 80 applications have been issued, whichever comes first.

Applications will need to be returned, in person, to Local 1010 JAC at the above address by no later than 1:00 p.m. on April 12, 2024.

The Committee requires that applicants:

  • Must be at least 18 years old.
  • Must be able to physically able to perform the work required of a Skilled Construction Craft Laborer and endure strenuous exertion and exposure to the elements.
  • Must be tested for the minimum physical condition at the time and place of personal submission of the completed application form by the applicant.
  • Must appear for physical evaluation which consists of:
    • Wheeling a wheelbarrow loaded with 150 pounds to a flat distance of 300 feet.
    • Lifting a 90-pound cement bag and carrying to a distance of 100 feet.
    • Carrying framing wood for a distance of 100 feet.
    • Digging a one-square-foot hole to a depth of one foot, and mixing sand and  cement as instructed.
