Federal Court Enters $9.9M Penalty and Injunction Against Man Found to Have Caused Thousands of Unlawful Spoofed Robocalls

 

A federal court in Montana entered a $9.9 million penalty on Tuesday against a man found responsible for causing thousands of unlawful and malicious “spoofed” robocalls to consumers across the nation. The court also imposed an injunction prohibiting any future violations of the Truth in Caller ID Act and Telephone Consumer Protection Act.

The case arose out of an investigation conducted by the Federal Communications Commission (FCC) into unlawful robocalls received by consumers in states including Florida, Georgia, Idaho, Iowa and Virginia in 2018. The calls displayed inaccurate caller IDs indicating they were from local phone numbers, inducing the recipients to answer the calls and listen to the recorded messages. Those messages included highly inflammatory and disturbing content, often directed at certain communities, that intended to offend or harm the recipients. For example, hundreds of the spoofed robocalls targeted residents of the Brooklyn, Iowa, area in the aftermath of a local woman’s murder. Similarly, more than 2,000 of the spoofed robocalls targeted residents of Charlottesville, Virginia, during the investigation and prosecution of James Alex Fields Jr. for killing one woman and injuring dozens during the “Unite the Right” rally in August 2017. Many consumers who received the calls submitted complaints to FCC and other law enforcement regarding unwanted and harassing robocalls.

FCC traced the unlawful spoofed robocalls to Scott Rhodes, a resident of Idaho and Montana, and in January 2021, FCC imposed a $9,918,000 forfeiture penalty against Rhodes. In September 2021, the Justice Department sued Rhodes in the District of Montana to recover that penalty and obtain an injunction. In October 2023, the United States moved for summary judgment, and the court subsequently entered an injunction and the full $9,918,000 forfeiture penalty against Rhodes, after concluding based on a de novo review of the evidence that Rhodes committed the violations found by FCC.

“The department is committed to protecting consumers from deceptive robocalls,” said Principal Deputy Assistant Attorney General Brian Boynton, head of the Justice Department’s Civil Division. “We are very pleased by the court’s judgment, and we will continue working with the FCC and other agency partners to vigorously enforce the telemarketing laws that prohibit these practices.”

“Virtually every Montanan has been the subject of unwanted and harassing robocalls, and the person responsible for such calls usually escapes accountability,” said U.S. Attorney Jesse Laslovich for the District of Montana. “But not this time. In placing thousands of harassing and malicious spoofing calls to consumers across the country, Rhodes showed a blatant disregard to caller ID and telephone consumer protection laws designed to prevent this sort of conduct. I applaud the court’s injunction and nearly $10 million forfeiture penalty that hold Rhodes accountable. These results send the clear message that the Justice Department is determined to protect consumers.”

Our agency will continue to relentlessly pursue these unwanted robocalls and build on our multi-faceted collaborative approach with law enforcement agencies at home, as well as the growing partnerships we’re fostering with our counterparts abroad, so that we can quickly and effectively neutralize bad actors.”

Bronx Daycare Provider Pleads Guilty To Sexual Exploitation Of A Child And Producing Child Pornography

 

Damian Williams, the United States Attorney for the Southern District of New York, announced that SILFREDO CASTILLO MARTINEZ pled guilty before U.S. District Judge Paul A. Engelmayer to a Superseding Information charging him with sexual exploitation of a child and production of child pornography.  

 

U.S. Attorney Damian Williams said: “Silfredo Castillo Martinez exploited the trust placed in him as a daycare provider by sexually abusing one of the minor children under his care and by forcing that child to perform sex acts on himAdditionally, Castillo Martinez had nearly 10,000 images depicting child pornography in his possession, all the while caring for children on a daily basisCastillo Martinez’s conduct is reprehensible, and he now faces more than a decade in prison for his crimes.” 

According to the allegations contained in the Superseding Information and the Complaint filed on March 10, 2023:

From in or about July 2015 through in or about at least May 3, 2022, CASTILLO MARTINEZ operated a licensed daycare facility for children at his residence in the Bronx, New York (the “Daycare Facility”). 

From at least in or about May 2018 through at least in or about July 2018, CASTILLO MARTINEZ induced an 11-year-old minor (“Minor Victim-1”) who attended the Daycare Facility to engage in sexually explicit conduct with him at the Daycare Facility while CASTILLO MARTINEZ recorded that conduct on his cellphone and camera. 

On or about May 3, 2022, law enforcement agents executed a search warrant at CASTILLO MARTINEZ’s residence and seized several electronic devices belonging to CASTILLO MARTINEZ.  Those devices contained, among other things, several images and a video containing child pornography depicting Minor Victim-1 and approximately 9,800 other images depicting child pornography.

CASTILLO MARTINEZ, 34, of the Bronx, New York, pled guilty to one count of production of child pornography and sexual exploitation of a child, which carries a mandatory minimum sentence of 15 years in prison and a maximum sentence of 30 years in prison.  CASTILLO MARTINEZ is scheduled to be sentenced by Judge Engelmayer on June 25, 2024, at 11:00 a.m. 

The minimum and maximum potential sentences in this case are prescribed by Congress and are provided here for informational purposes only, as any sentencing of the defendant will be determined by the judge.

Mr. Williams praised the outstanding investigative work of the U.S. Secret Service’s Internet Crimes Against Children Task Force, the Federal Bureau of Investigation, and the New York City Police Department.  Mr. Williams also thanked the Bronx County District Attorney’s Office for its assistance.

This week, Senator Rivera introduced legislation (S.8843) that would require public notice and community engagement when a hospital seeks to either close entirely or close a unit that provides emergency, maternity, mental health, or substance use care.


The legislation will address current gaps in the state’s review of proposed hospital and critical unit closures by requiring adequate advance notice to local officials and the public, a community forum held 150 days in advance of the proposed closure date to allow public comment on the hospital’s plan, a final closure plan that addresses concerns raised at the community forum, and public disclosure of all submitted plans by the Department of Health.

MARY MITCHELL FAMILY AND YOUTH CENTER CELEBRATES CAPITAL AND OPERATIONAL FUNDING FROM SENATOR RIVERA

Today, the Mary Mitchell Family and Youth Center celebrated the arrival of $350,000 in capital and operational funding allocated by Senator Rivera to support their youth and food distribution programs. While the Center is now out of Senator Rivera's district, this funding was allocated when the Senator represented the center in his old district.


Marry Mitchell received a State and Municipal Facilities Grant (SAM) from State Senator Gustavo Rivera for $100,000 to purchase a 15-passenger van, 13 tablets, two computers, and kitchen supplies. Additionally, Senator Rivera allocated $250,000 in operational funds to Mary Mitchell to support the purchase of supplies for the various programs it operates.


SENATOR RIVERA STANDS WITH TENANTS IN HIS DISTRICT TO SUPPORT THE PASSAGE OF THE TENANT OPPORTUNITY TO PURCHASE ACT

Senator Rivera joined organizers from Northwest Bronx Community Clergy Coalition and members of Tenants' Association at 124 East 176th Street to support passing the Tenant Opportunity to Purchase Act (TOPA) sponsored by Senator Zellnor Myrie.


Senator Rivera has met with the Tenant Association of this building and other buildings owned by David Kleiner, who continues to show a history of neglecting his tenants. His neglect directly led to the partial collapse of the building at 1915 Billingsley Avenue, leading to the displacement of dozens of tenants from their homes.


TOPA gives most tenants or non-profit organizations priority to collectively purchase rental housing before owners can sell to third party buyers. The bill outlines tenant eligibility, timelines to make purchase offers, purchaser qualifications by state agencies, and some exemptions for certain property types and ownership structures. Senator Rivera made it clear that we must pass this bill to ensure that if neglectful landlords like Mr. Kleiner are unable to do their job, tenants should have the right to take over the building.

BRAC is proud to announce the upcoming exhibition, Never Wait! / ¡Nunca Esperes!. This exhibition showcases the Bronx’s visual arts community in a distinctive light that sets it apart from the rest of NYC. Running from April 13 to June 8, 2024, Never Wait! / ¡Nunca Esperes! offers a glimpse into over a decade of alternative artist-run endeavors that have blossomed from the South Bronx to Athens, Greece. Produced by Bronx-based Mexican-American Artist, project initiator, and organizer Blanka Amezkua, the show will spotlight her efforts to foster dialogue and advocate for multicultural perspectives and non-traditional modes of art practice.

This show brings together artists from five manifestations of Amezkua’s cultural work: The Bronx Blue Bedroom Project (BBBP), a pioneering artist-run initiative in her bedroom that ran from 2008-2010, Alexander Avenue Apartment 3A (AAA3A), an alternative space offering food, dialogue, workshops, and art, which Amezkua has been producing in her unfurnished South Bronx living room since 2016, Fo Kia Nou 24/7, a project space in an intimate apartment in the center of Athens, Greece that encouraged creative collaboration between Greek and foreign artists from 2014 to 2016, 8 to 8: State of Creative Emergency, an initiative where creative minds are invited to construct and realize a unique project and execute it for 12 hours straight; from 8am to 8pm, and 3///3...three walls on Wednesday, an alternative initiative to exhibit art from national and international artists in Athens, Greece.   

 

A zine publication highlighting the artists and artwork of Amezkua’s many initiatives will accompany the exhibition. The zine will be available at BRAC and other cultural institutions around the Bronx. 

 

Never Wait! / ¡Nunca Esperes! aspires to spark dialogue, inspire engagement, and deepen appreciation for The Bronx's cultural heritage and its connections to the international art world. The collaboration between Amezkua and BRAC strives to shed light on the phenomena of alternative artist-run spaces within our vibrant community.

DEC Reminds New Yorkers About April 1 Start of Spring Trout Fishing Season

April 1 Marks Start of Harvest Season and End of Catch-and-Release-Only Season for Trout

New York State Department of Environmental Conservation (DEC) Commissioner Basil Seggos reminded New Yorkers of the April 1 start of the trout fishing season, a spring tradition bolstered by DEC's extensive stocking program and New York’s world-renowned wild trout fisheries. DEC's spring trout stocking, which began in March and runs through early June, will include more than 1.9 million trout being stocked in waters statewide, enhancing the diversity of excellent fishing opportunities available to anglers in New York State.

“The mild winter afforded New Yorkers some trout fishing opportunities during the catch-and-release season,” Commissioner Seggos said. “However, April 1, the traditional opening day of inland trout fishing season, brings the excitement to another level as spring arrives and the state’s streams and ponds are stocked to provide additional opportunities for anglers.”

April 1 marks the opening of the harvest season after year-round fishing was greenlit on most streams in 2021, with the implementation of an Oct.16 to March 31 "artificial lures only, catch-and-release" season.

DEC trout stocking began in March and will include the placement of 1,909,450 catchable size brook, brown, and rainbow trout in streams and ponds across the state by early June. “Stocked-Extended” streams, listed in the Inland Trout Streams Regulations section of the freshwater fishing regulations guide, will receive fish every other week for two months to enhance season-long opportunities for angler success. Most streams will also receive a seeding of larger stocked trout. Spring trout stocking lists, including the week of stocking for trout streams, can be found at DEC's website.

Stocking information, along with fishing regulations, maps, and access information is available in “The Tackle Box” feature of the DEC “HuntFishNY” smartphone app. Other features include driving directions to state boat launch sites and an offline feature that allows a user to access information when cell coverage isn't available.
