Governor Hochul Announces New York's Third Offshore Wind Solicitation to Accelerate Clean Energy Development

Seeks to Procure at Least 2,000 Megawatts of Renewable Energy, Enough to Power 1.5 Million Homes

Implements Nation-Leading $500 Million Offshore Wind Infrastructure Investment,

New Commitments to Support U.S. Iron and Steel, Stakeholder Engagement, Jobs, and Workforce Development

 Governor Kathy Hochul today announced the release of New York's third competitive offshore wind solicitation, seeking enough clean, renewable energy to power at least 1.5 million New York homes. The procurement, administered by the New York State Energy Research and Development Authority, includes the first phase of the nation-leading $500 million investment in offshore wind ports, manufacturing, and supply chain infrastructure as announced in the Governor's 2022 State of the State. Today's announcement builds on a series of significant offshore wind developments for the State in 2022, including the groundbreaking of New York's first offshore wind project, and is a critical next step toward achieving New York's Climate Leadership and Community Protection Act (Climate Act) goal to develop 9,000 megawatts of offshore wind by 2035. 

"New York is proud to continue leading the way in offshore wind development while establishing a blueprint for building a locally-based green economy," Governor Hochul said. "Today we are putting words into action and making it clear that New York State is the national hub of the offshore wind industry. The clean energy transition is driving significant private investment and family-sustaining jobs in communities across the state, and we are setting ourselves up for success with a brighter and more sustainable future." 

As the nation's leading hub for offshore wind, New York State is seeking to procure at least 2,000 megawatts of offshore wind energy through a diverse set of project proposals while leveraging public and private capital to build a robust supply chain. In addition to the first phase of the State's $500 million investment in ports, manufacturing and supply chain infrastructure, additional notable provisions within the solicitation include: 

• Introducing a first of its kind "meshed ready" offshore transmission configuration, based on recommendations from the New York State Power Grid Study, which will facilitate offshore wind projects' transition to a future system that can grow over time and provide greater reliability and flexibility while setting New Yorkers up to save approximately $55-$60 million annually; 
• Awarding evaluation points for repurposing existing downstate fossil-based electric generation infrastructure and utilizing energy storage to enhance future system reliability and support more renewable energy on the grid; 
• Emphasizing in-state manufacturing, inclusive economic development and climate equity, fostering relationships with New York's workforce including construction backed by prevailing wage, and encouraging project labor agreements; 
• In promoting the intent of the New York Buy American Act, the solicitation sets a minimum U.S. iron and steel purchase requirement for all projects awarded under the solicitation to encourage domestic steel production and requiring developers to provide opportunities for U.S.-based steel suppliers to participate in the growing offshore wind industry; 
• Enhancing stakeholder engagement, tracking, and requirements for New York jobs; and 
• Continuing support for responsible development through environmental and fisheries mitigation plans and the requirement to support monitoring of fisheries and wildlife to better understand the interactions with offshore wind projects.

Proposals are due on December 22, 2022, by 3:00 p.m. A webinar will be held on August 23, 2022, at 10:00 a.m. to provide more information on this solicitation. To ensure that the procurement advances New York's offshore wind goals in a thoughtful, cost-effective, and environmentally responsible manner to the benefit of all New Yorkers, a draft version of this solicitation was released for public comment in March 2022 and a follow-up Request for Information in May 2022, with over 1,300 comments received. NYSERDA has incorporated the feedback received into the solicitation. 

New York State's Nation-Leading Climate Plan 

New York State's nation-leading climate agenda is the most aggressive climate and clean energy initiative in the nation, calling for an orderly and just transition to clean energy that creates jobs and continues fostering a green economy as New York State recovers from the COVID-19 pandemic. Enshrined into law through the Climate Leadership and Community Protection Act, New York is on a path to achieve its mandated goal of a zero-emission electricity sector by 2040, including 70 percent renewable energy generation by 2030, and to reach economy wide carbon neutrality. It builds on New York's unprecedented investments to ramp-up clean energy including over $35 billion in 120 large-scale renewable and transmission projects across the state, $6.8 billion to reduce buildings emissions, $1.8 billion to scale up solar, more than $1 billion for clean transportation initiatives, and over $1.6 billion in NY Green Bank commitments. Combined, these investments are supporting nearly 158,000 jobs in New York's clean energy sector in 2020, a 2,100 percent growth in the distributed solar sector since 2011 and a commitment to develop 9,000 megawatts of offshore wind by 2035. Under the Climate Act, New York will build on this progress and reduce greenhouse gas emissions by 85 percent from 1990 levels by 2050, while ensuring that at least 35 percent with a goal of 40 percent of the benefits of clean energy investments are directed to disadvantaged communities, and advance progress towards the state's 2025 energy efficiency target of reducing on-site energy consumption by 185 trillion BTUs of end-use energy savings.

Concert Series to Include Mary Mary, HoodCelebrity, Mase, Funk Flex, and More for Celebration of Culture, Music, and Unity

 

New York City Mayor Eric Adams today announced the launch of the ‘Rise Up NYC’ concert series which will provide 10 free community concerts that will be performed across all five boroughs this summer. The concert series seeks to encourage New Yorkers to explore all of the city and reconnect with one another as the city emerges from the COVID-19 pandemic. Starting tonight, New Yorkers can access free, safe concerts at a time when rising costs are putting a strain on many families. The series will present performances by critically acclaimed artists, including gospel singers Mary Mary, Caribbean hitmaker Mr. Vegas, renowned Hot 97 Disc Jockey Funk Flex, and more. 

 

“We are inviting all New Yorkers to come together to celebrate culture, music, and unity as New York City rebounds from the pandemic. Our city overcame many challenges over the past few years, but ‘Rise Up NYC’ will allow New Yorkers to enjoy one another and the city we call home once more,” said Mayor Adams. “Music and the arts were a lifeline for us all during the last two years, and I am here to say that New York City supports its local artists and communities. Chicago Man Pleads Guilty to Stalking R. Kelly Victim

 

Donnell Russell, a Self-Described Manager and Advisor of R. Kelly, Used the Mail, the Internet, and Cellular Phones to Harass and Intimidate Victim and Her Mother

 Donnell Russell pleaded guilty to interstate stalking for his participation in a scheme to harass, intimidate, and cause substantial emotional distress to Jane Doe, a victim in the racketeering case against Robert Sylvester Kelly, also known as “R. Kelly,” and Jane Doe’s mother.  The proceeding was held before United States District Judge Ann M. Donnelly.  When sentenced, Russell faces a maximum sentence of five years’ imprisonment. 

Breon Peace, United States Attorney for the Eastern District of New York, and Ricky J. Patel, Acting Special Agent-in-Charge, Homeland Security Investigations, New York (HSI), announced the guilty plea.

“Russell used threats, harassment and intimidation in a deliberate effort to silence one of R. Kelly’s victims and prevent her voice from being heard,” stated United States Attorney Peace.  “When his initial effort failed, he continued his vile campaign by sending threatening messages to Jane Doe and her mother, and publishing explicit photos of the victim on the internet before and after Kelly was indicted.  As this prosecution makes clear, the defendant’s conduct was not only reprehensible, but it was also criminal and will not be tolerated.” 

“Through the use of intimidation tactics, Russell repeatedly and purposefully worked to silence ‘Jane Doe’ from revealing the emotional and physical trauma inflicted on her by R Kelly and his associates. Despite multiple threats, Russell ultimately failed in his efforts and will now face the consequences of his despicable behavior,” said HSI Acting Special Agent-in-Charge Patel. “HSI will continue to work together with our partners to support and empower survivors of abuse and exploitation to come forward and speak out against their abusers.”

Between November 2018 and February 2020, Russell, a self-described manager, advisor and friend of Kelly, used the mail, phones and the internet to harass and intimidate Jane Doe, a victim in the Kelly case, and her mother after Jane Doe filed a civil lawsuit against R. Kelly.  Specifically, Russell threatened to reveal sexually explicit photographs of Jane Doe and to publicly reveal her sexual history if she did not withdraw her lawsuit against Kelly and “cease her participation and association with the organizers” of a “negative campaign” against Kelly.  In November 2018, Russell caused a letter, with attachments, purportedly written by Kelly to be mailed to Jane Doe’s Brooklyn-based lawyer at the time.  The attachments included cropped nude photographs of Jane Doe with the following text: “the next two pictures have been cropped for the sake of not exposing her extremities to the world, yet!!!”  In December 2018, Russell, using his alias “Colon Dunn,” sent a series of text messages to Jane Doe and her mother, which contained the same photographs of Jane Doe, and stating, “Just a sample.  We will seek criminal charges.  You’ve been warned,” as well as “Publishing soon” and “[T]his is Colon.”   

On January 3, 2019, Russell sent additional text messages to Jane Doe and her mother, stating, “Pull the plug or you will be exposed.”  On January 6, 2019, Russell, using the Colon Dunn alias, created a Facebook Page named “Surviving Lies,” a play on the title of Lifetime’s “Surviving R Kelly” documentary, and posted screen shots of text messages between Kelly and Jane Doe, which contained the same sexually explicit photographs of Jane Doe.  In late January 2020, Russell appeared on two live interviews with “vloggers” supporting Kelly discussing Kelly’s legal troubles, which were streamed live on the internet via YouTube.  Russell again displayed the same sexually explicit photographs of Jane Doe and broadcast them publicly over the internet.

Phishing Scams Work When Someone Poses as a Representative of a Financial Institution to Steal Your Personal and Financial Information

 The New York State Division of Consumer Protection today warned New Yorkers of a text phishing scheme targeting cell phone users with an attempt to steal their information. Fraudsters are impersonating financial institutions claiming that a customer’s account is compromised ‘due to unusual activity’, but the message is an attempt to deceive the recipient into sharing personal information.

These scams usually work when someone poses as a representative of a bank or financial institution to get information such as your credit card number, bank account number, or social security number. This is known as phishing. The message usually asks the users to confirm their account information, make a payment, or claim a prize. The link may also ask the users to click on the link inside the text, which  directs them to a phony site that looks like the financial institution’s website, or it may install malware onto their device. The illicit text message shown below impersonates a bank in an attempt to gain access to personal information. Anyone who receives a fraudulent text message should delete the message right away.

Secretary of State Robert J. Rodriguez said, “With the advances in technology, unscrupulous individuals are becoming more creative in how to steal your personal information which can result in identity theft and serious financial hardship. Anyone who receives unsolicited dubious text messages should delete them right away. The Division of Consumer Protection works tirelessly to make people aware of schemes such as the phishing texts trying to steal your financial and personal information with just a click on a fraudulent link.”

New York State Chief Information Officer Angelo "Tony" Riddick said, “One of the most common online scams is phishing—an attempt to solicit personal information from users by masquerading as a trustworthy entity. The Consumer Alert today warning of text scams involving fake bank fraud informs New Yorkers to remain vigilant by deleting the fraudulent text message immediately. The public should always remember the importance of protecting their personal data from cyber criminals. ITS continues to provide a wide variety of helpful cyber tips for the public, online safety resources and real-time advisories that can help safeguard against cybercrime.”

Superintendent of Financial Services Adrienne A. Harris said, “Phishing scams regularly exploit the trust built between an individual and a financial institution to obtain highly sensitive information, which can be used to steal your identity or your hard-earned money. Cyber threats can take many different forms, targeting both consumers and businesses directly. DFS will continue working with regulated financial institutions to monitor cybersecurity trends and implement best practices to ensure consumer data is safeguarded from malicious actors.”

New York State Police Superintendent Kevin P. Bruen said, “We urge all New Yorkers to take extreme caution if they receive any type of correspondence from a financial institution requesting personal information or that an account has been compromised. Even if a text message or website looks valid, do not provide any information without confirmation. We want to remind people to contact their financial institution first and to check statements regularly to ensure they are not a victim of fraud.  The State Police will continue to work with our law enforcement partners to put a stop to these schemes and hold accountable those who prey on innocent people.”

To help protect against phishing or smishing (SMS phishing) scams, the NYS Office of Information Technology Services (ITS) and the Division of Consumer Protection recommend the following precautions:

The things to remember the next time you receive an unsolicited text message from a bank or financial institution:

1. Inspect the sender’s information to confirm that the message was generated from a legitimate source, but don’t click on the link or call the number on the text.
   
   
2. Do not respond to the text. Even writing STOP will let the scammer know your number is genuine, and they may sell your number to other scammers, making the problem worse.

3. Remember, banks will never ask you to provide confidential information through text. Requests to do so, as well as poor spelling or grammar, are telltale signs of a scam.

4. If you are suspicious, call the alleged bank or financial institution directly to understand the protocols for alerting customers of potential fraud.

5. Do Not post sensitive information online.  The less information you post, the less data you make available to a cybercriminal for use in developing a potential attack or scams.

6. Keep an eye out for misspelled words which are used to bypass a phone carrier’s filter system for fraud.

One simple method for preventing spam texts is to block unknown senders from your cell phone:

• Go to settings on your phone
• Click on messages or block numbers (depending on your phone type)
• Hit “Filter Unknown Senders” or tap on “Block Numbers” (depending on your phone type)

Governor Hochul and Mayor Adams Announce Groundbreaking on $189 Million Affordable and Supportive Housing Development in the Bronx

Starhill Phase I will Create 326 New Affordable Homes in Morris Heights with 200 Supportive Homes for Adults Experiencing Homelessness

 Governor Kathy Hochul and New York City Mayor Eric Adams today announced the groundbreaking on a $189 million affordable housing development in the Morris Heights section of the Bronx. Starhill Phase I will feature 326 affordable apartments, including 200 homes with supportive services for individuals experiencing homelessness. 

"This development will provide safe, stable homes for more than 300 residents of The Bronx and offer critical resources and amenities to support the Morris Heights neighborhood in the long term," Governor Hochul said. "As the national affordability crisis drives rent and other costs to new highs, my administration is tackling the crisis head-on with a $25 billion plan to deliver high-quality affordable and supportive housing that will help to stabilize and improve New Yorkers' lives. I thank Mayor Adams, the City Council, and other stakeholders for their partnership on this project, and look forward to their continued engagement in strengthening New York communities." 

"Safe, stable, and affordable housing is fundamental to a prosperous, inclusive city, and we are ensuring no New Yorker is left behind when it comes to having a roof over their heads," said Mayor Adams. "Our administration has a plan to kickstart the creation of supportive homes for New Yorkers who need them most, and we are moving full speed ahead. We are working with closely with Governor Hochul to 'Get Stuff Done' for New Yorkers and make our city stronger and fairer."    

Starhill Phase I is part of Governor Hochul's sweeping plans to make housing more affordable, equitable, and stable. The Governor has introduced and successfully secured, in the FY2023 Enacted Budget, a new $25 billion, five-year, comprehensive housing plan that will increase housing supply by creating or preserving 100,000 affordable homes across New York including 10,000 with support services for vulnerable populations, plus the electrification of an additional 50,000 homes.   

Starhill Phase I will consist of a 14-story multifamily building and a connected one-story amenity building. The two-acre site had been occupied by a former hospital being used as a residential treatment center, which has since been demolished. The mixed-use development was made possible through the 2018 Jerome Corridor Rezoning. 

The new building will include 200 apartments reserved for adults experiencing homelessness, including those with a substance use disorder or co-occurring disorder. These residents will have access to on-site supportive services and rental subsidies funded through the Empire State Supportive Housing Initiative and administered by the New York State Office of Addiction Services and Supports. 

Services will include individual case management, family counseling, job readiness training, and financial literacy workshops. These services will be voluntary and individualized to each tenant's needs while promoting independent living skills and maintaining stable tenancy. The service provider is Services for the UnderServed (S:US). 

The remaining apartments will be reserved for households earning between 30 and 80 percent of the area median income or less. There will be one apartment for an on-site superintendent. 

Residential amenities will include a rear yard and a passive recreation area on the second-floor terrace. Interior amenities will include on-site social services, a fitness room, on-site laundry, a children's playroom, a computer room, and free internet access available in each unit. In addition, there will be 24-hour security located at the entrance. 

Starhill Phase I is conveniently located in the Morris Heights residential neighborhood in the Bronx with access to local amenities such as medical, education and public services. There are 10 MTA bus lines with stops near the development site as well as the 4, B and D trains. The developers for Starhill Phase I are Bronx Pro and S:US.  

State financing for Starhill Phase I includes $20.6 million in permanent tax-exempt bonds, Federal Low-Income Tax Credits that will generate $80.5 million in equity and $31.5 million in subsidy from New York State Homes and Community Renewal. The New York City Department of Housing Preservation and Development is providing $31.5 million through the Supportive Housing Loan Program. The New York City Council is providing $1 million. 

Starhill Phase II is expected to include approximately 244 additional affordable and supportive apartments.

MAYOR ADAMS, BIC COMMISSIONER CROTTY ANNOUNCE ARRESTS RELATED TO UNLAWFUL WASTE HAULING ACTIVITY ON JFK AIRPORT CONSTRUCTION PROJECT

 

Three Construction Companies Accused of Operating Waste Hauling Business Without BIC Registration

 

Arrests Coordinated in Partnership with NYPD, Queens DA, and Office of the Inspector General for the Port Authority of New York and New Jersey

New York City Mayor Eric Adams, New York City Business Integrity Commission (BIC) Commissioner and Chair Elizabeth Crotty, the Office of Inspector General for the Port Authority of New York and New Jersey (PAOIG), and Queens County District Attorney Melinda Katz today announced that three companies have been charged with unlawful waste hauling in connection with construction work to modernize John F. Kennedy (JFK) International Airport. The three companies involved in this investigation — LMC Trucking Corp., Ferreira Construction Co. Inc., and Bond Civil & Utility Construction, Inc. — all lack the BIC license or registration that is required in order to operate as a waste hauler in New York City.

 

“We cannot allow commercial waste hauling to become a dirty business,” said Mayor Adams. “New Yorkers deserve clean business practices in every industry, and on my watch, that’s what they will get. We will not tolerate criminal activity that threatens our public safety or the integrity of a critical industry. These three companies operated without the proper trade waste license or registration, and one even conducted trade-waste-related business with members of organized crime. And now all three companies will pay the price and face the consequences. I want to thank our partners in law enforcement for their diligent work in holding these companies accountable and making clear that law and order doesn’t just apply to violent crime.”

 

BIC — the city agency charged with regulating the commercial waste hauling or “trade waste” industry — even previously denied the application for a waste hauling registration of LMC Trucking Corp. The company’s application was denied in 2020 on the grounds that the company falsely represented who operated the entity in its application to BIC, conducted trade waste-related business with members of organized crime, and defrauded a trade waste union by paying employees in cash and failing to pay union benefits. The company’s continued operation of its trade waste business in defiance of BIC’s denial led to the arrest and related charges. 

 

Operating a trade waste business without a BIC license or registration is punishable by imprisonment of up to six months and a criminal fine of up to $10,000 for unlicensed activity, or $5,000 for unregistered activity for each day of violation.

 

“Corruption in the trade waste industry undermines fairness, transparency, and public faith in good government,” said City Hall Chief Counsel Brendan McGuire. “This case is yet another example of the important role the Business Integrity Commission plays in demanding honesty and accountability from those who conduct business in this city.”

 

“Companies that operate without the required regulation by BIC present a public safety and corruption risk to New York City. Illegal trade waste hauling cannot be allowed to occur on public works projects,” said BIC Commissioner and Chair Crotty. “LMC Trucking Corp. is an especially egregious case because the company’s application for a BIC registration was denied when the company was found to lack the good character, honesty, and integrity required to operate lawfully in this industry. I would like to express my gratitude to the NYPD, the PAOIG, and the Queens District Attorney’s Office for their collaboration on this matter.”

“It is imperative that we keep the busiest port on the East Coast operating safely and with the utmost integrity,” said New York City Police Department Commissioner Keechant L. Sewell. “Not only is it our responsibility, it is critical to the infrastructure, economy, and vitality of our nation. This investigation exemplifies the significance of interagency collaboration when serving New Yorkers, and we thank everyone involved in this important case from the Mayor’s Office, the New York City Business Integrity Commission, the Queens District Attorney’s Office, and the Port Authority of New York and New Jersey.”
