U.S. Attorney Announces Return Of Collection Of Antiquities From The Metropolitan Museum Of Art To Cambodia

 

Returned Antiquities Include Statues from the Koh Ker Archeological Site

Damian Williams, the United States Attorney for the Southern District of New York, and Erin Keegan, the Acting Special Agent in Charge of the New York Field Office of Homeland Security Investigations (“HSI”), announced today the return of 13 Khmer antiquities to the Kingdom of Cambodia, pursuant to an agreement between the U.S. Attorney’s Office for the Southern District of New York and the Metropolitan Museum of Art (the “Met”).  The Met has voluntarily agreed to return the antiquities, and they are in the process of being turned over.   

U.S. Attorney Damian Williams said: “All of the pieces being returned today were tied directly to illicit trafficking, and specifically to a man named Douglas Latchford – a collector and dealer that my Office charged in 2019 for running a vast antiquities trafficking network out of Southeast AsiaI want to thank the Metropolitan Museum of Art, where these pieces were previously housed, for their decision to cooperate and work with my Office to facilitate the return of these pieces to the Kingdom of CambodiaWe look forward to our continued dialogue with the Met on these important issuesMy Office will continue to vigorously investigate the illegal trade in stolen antiquitiesWe urge those in this space, including cultural institutions, to be vigilant.  And if you work at one of these institutions or for a private collection and have concerns that certain pieces may be tied to illicit trafficking, do the right thing: come forward and work with us on a voluntary basis to facilitate the return to the rightful ownersThat is a far better outcome for you and your institution than if our investigation leads to a knock on your doorIn other words, come see us before we come see you.” 

HSI Acting Special Agent in Charge Erin Keegan said: “As demonstrated with today's announcement, pieces linked to the investigation of Douglas Latchford continue to reveal themselves.  The Metropolitan Museum of Art has not only recognized the significance of these 13 Khmer artifacts, which were shamelessly stolen, but has also volunteered to return them, as part of their ongoing cooperation, to their rightful owners: the People of Cambodia.  I want to thank HSI New York’s Cultural Property, Art, and Antiquities unit and the Southern District of New York for their unwavering commitment to reuniting nations with these unforgettable pieces of history.”

All of the antiquities being returned to the Kingdom of Cambodia are linked to the art dealer and collector Douglas Latchford, who was previously indicted in the Southern District of New York in 2019 for orchestrating a multi-year scheme to sell looted Cambodian antiquities on the international art market.  The Indictment was later dismissed due to Latchford’s death.  Since 2012, the U.S. Attorney’s Office for the Southern District of New York, in partnership with HSI, has successfully investigated, identified, and repatriated dozens of stolen and illegally imported Cambodian antiquities in the possession of individuals and institutions in the United States. 

Among the statutes being returned to the Kingdom of Cambodia are statutes from the Koh Ker archaeological site, including a 10th century goddess sandstone statute, as depicted below.  The history of Koh Ker and the illicit trafficking in Cambodian cultural patrimony is described in prior forfeiture actions filed in the Southern District of New York, including United States v. A Late 12th Century Khmer Sandstone Sculpture Depicting Standing Prajnaparamita, et al., 21 Civ. 9217; United States v. A Late 12th Century Bayon-Style Sandstone Sculpture Depicting Eight-Armed Avalokiteshvara, 22 Civ. 229;  United States v. A 10th Century Cambodian Sandstone Sculpture, 12 Civ. 2600; and United States v. A 10th Century Cambodian Sandstone Sculpture Depicting Skanda on a Peacock, 21 Civ. 6065.  In September 2023, Koh Ker — the 10th Century former royal capital of the Angkorian empire — was officially added to the United Nations Education, Scientific, and Cultural Organization’s World Heritage List.  Other statutes being returned date from as far back as the 7th Century, including an over-life-size head of Buddha.

Mr. Williams thanked HSI for its outstanding work to facilitate the repatriation and praised its ongoing efforts to find and repatriate stolen and looted cultural property.  Mr. Williams also thanked the Kingdom of Cambodia’s Ministry of Culture and Fine Arts for its partnership and assistance.

Executives Charged with Bid Rigging, Territorial Allocation and Defrauding the U.S. Forest Service After a Wiretap Investigation

 

Following a court-authorized wiretap investigation, a federal grand jury in Boise, Idaho, returned an indictment this week charging two executives of competing companies with conspiring to rig bids and allocate territories in violation of the Sherman Act, conspiring to commit wire fraud and committing wire fraud.

According to the seven-count felony indictment, Ike Tomlinson and Kris Bird’s conspiracy affected contracts for forest-firefighting services. As alleged, the U.S. Forest Service runs a competitive bidding process for these contracts to ensure taxpayer dollars are spent efficiently. The indictment alleges that from at least in or about February 2014, up to and including in or about March, the defendants coordinated their bids to “squeeze” and “drown” competitors; accepted payment for fuel trucks at collusive and noncompetitive daily rates; and tried to conceal their actions.  

This investigation was conducted by the department’s Procurement Collusion Strike Force (PCSF), which included FBI agents, with judicial authorization, intercepting phone calls between the defendants. As alleged, Tomlinson and Bird spoke with one another shortly before the deadline to submit bids on fuel truck contracts. During calls quoted in the indictment, they allegedly agreed to rig bids, allocate territories and target competitors.

A violation of the Sherman Act carries a maximum penalty of 10 years in prison and a $1 million fine for individuals and a maximum penalty of a $100 million fine for corporations. The maximum fine may be increased to twice the gain derived from the crime or twice the loss suffered by victims if either amount is greater than the maximum. A violation of the wire fraud statute carries a maximum penalty of 20 years in prison. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

The Antitrust Division’s San Francisco Office, U.S. Attorney’s Office for the District of Idaho and FBI Salt Lake City Field Office, Boise Resident Agency are investigating the case.

Trial Attorney Matthew Chou and Assistant Chief Christopher J. Carlberg of the Antitrust Division’s San Francisco Office and Assistant U.S. Attorney Sean M. Mazorol for the District of Idaho are prosecuting the case.

In November 2019, the Justice Department created the PCSF, a joint law enforcement effort to combat antitrust crimes and related fraudulent schemes that impact government procurement, grant and program funding at all levels of government – federal, state and local. An indictment is merely an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

BRONX MAN SENTENCED TO 20 YEARS IN PRISON FOR KNIFEPOINT RAPE OF WOMAN IN ST. MARY’S PARK IN BROAD DAYLIGHT


 Bronx District Attorney Darcel D. Clark announced that a Bronx Man was sentenced to 20 years in prison and 20 years post release supervision for raping a woman at knifepoint in Saint Mary’s Park. 

 District Attorney Clark said, “Thanks to the swift actions of the victim’s son, authorities were able to apprehend the rapist, and now he will serve 20 years in prison for this brutal attack.”

 District Attorney Clark said the defendant, Christopher Martinez, 20, of 620 East 137th Street was sentenced to 20 years in prison and 20 years post release supervision by Bronx Supreme Court Justice Laurence Busching on December 12, 2023. The defendant pleaded guilty on November 6, 2023 to first-degree Rape and first-degree Criminal Sexual Act.  

 According to the investigation, on May 31, 2022, the defendant was waiting near the victim’s home in Mott Haven after she dropped one of hersons off atschool. Martinez approached her and robbed her at knifepoint of $60 and a credit card. He then took her to Saint Mary’s Park where he raped her. The victim’s other son was home and called the police when he noticed his mother had not returned home from dropping his brother off, and then saw her with the defendant nearby. DNA collected from the victim after the rape matched the defendant’s DNA.

 District Attorney Clark thanked Detective Eddy Soriano of the NYPD Bronx Special Victims Squad for his work on the case.

MAYOR ADAMS ANNOUNCES PROGRESS CONNECTING NEW YORKERS IN SHELTER TO PERMANENT HOUSING, TECHNOLOGY IMPROVEMENTS HELP BOOST SHELTER ACCESS

City Announces First Permanent Housing Placements Through Statewide Expansion of CityFHEPS 


New York City Mayor Eric Adams and New York City Department of Social Services (DSS) Commissioner Molly Wasow Park today announced continued progress connecting New Yorkers living in shelter to permanent housing, with technological improvements to further streamline access to City Fighting Homelessness and Eviction Prevention (CityFHEPS) vouchers, the largest city-funded rental assistance program in the nation. CityFHEPS voucher holders will now be able to renew their CityFHEPS case and check the status of their case online using DSS’s benefits portal,ACCESS HRA and the ACCESS HRA Mobileapplication, ensuring long-term housing stability for CityFHEPS voucher holders. 

 

The Adams administration also announced that as a result of robust CityFHEPS reforms — including lifting the 90-day rule, as well as staffing, process, and training improvements — permanent housing placements from shelter using CityFHEPS vouchers have increased 10 percent during the first three months of Fiscal Year 2024 (FY24) compared to the first three months of FY23. Additionally, in the two months since Mayor Adams expanded the use of CityFHEPS to obtain permanent housing in any county or locality across New York Statethe city announced that 15 households are already in the process of moving or have moved to localities outside of New York City where they can now utilize CityFHEPS vouchers. 

 

As rents continue to rise across the city and put pressure on working-class New Yorkers, this administration has made historic progress connecting New Yorkers to permanent, affordable homes,” said Mayor Adams. “From lifting the 90-day rule, to expanding CityFHEPS eligibility, to allowing New Yorkers to use CityFHEPS statewide, to continued technology investments, our work has helped connect a record number of New Yorkers to permanent housing using CityFHEPS vouchers. We’ll continue to use every tool available to move New Yorkers out of shelter and into the homes they need.” 

 

Every New Yorker needs a permanent home,” said Deputy Mayor for Health and Human Services Anne Williams-Isom. “To actualize that goal, we have taken a number of steps to help people transition more quickly from shelter to housing. Today’s announcement marks additional progress with the use of technology to ease access to vouchers. Increasing and improving access has and will continue to be a priority for our administration. The changes we have made so far have helped us place more individuals and families in permanent housing. Thank you to the teams making this work possible."  

 

"CityFHEPS vouchers are a critical lifeline for New Yorkers in shelter and today’s announcements demonstrate our ongoing commitment to strengthening access to the program for our most vulnerable New Yorkers,” said DSS Commissioner Park. “Despite the winding down of key pandemic-related federal supports and the severe shortage of affordable housing in New York City, we continue to make vital progress connecting households in shelter to permanent housing using CityFHEPS vouchers. This administration’s robust set of reforms and key training and process improvements are clearly having an impact, and we look forward to building on this progress while also using every tool at our disposal to create stable housing opportunities for New Yorkers experiencing homelessness.”  

 

These announcements build on the Adams administration’s record-breaking efforts to create and connect New Yorkers to safe, high-quality, permanent, affordable homes in FY23. Since taking office, the city has implemented numerous reforms to the CityFHEPS program to expeditiously facilitate exits from sheltereliminated the 90-day minimum length of shelter stay requirementallowed New Yorkers to use a CityFHEPS voucher anywhere in the stateand reduced the number of hours required for a family to work from 30 hours a week to 10 hours.  

 

With a vacancy rate for affordable housing ranging between 1 and 5 percent, many New Yorkers have had a difficult time finding an apartment even after receiving a voucher. Currently, approximately 10,000 households in shelter have qualified for a CityFHEPS voucher but are unable to use it due to a lack of housing. To address this issue, Mayor Adams has focused on cutting red tape and streamlining government processes to accelerate the production of new housing and continues to advance his “City of Yes for Housing Opportunity” proposal to create more than 100,000 homes through historic zoning changes. 

 

The city has also focused on technology improvements that make it easier for New Yorkers to access their benefits. Beginning this week, CityFHEPS voucher holders will be able to renew and check the status of their application online using DSS’s benefits portal ACCESS HRA and the ACCESS HRA mobileapp. Featured CityFHEPS updates on the ACCESS HRA portal include: 

 

  •    CityFHEPS Cases: CityFHEPS is being introduced into the ACCESS HRA family of benefit programs. Clients will now be able to link to their CityFHEPS case and view information about their case online. 
  •   CityFHEPS Renewals: Eligible clients can now submit their CityFHEPS Renewal and upload any supporting documents using the ACCESS HRA Mobile App. 
  •   CityFHEPS Good Cause Requests: Clients who are completing their fifth-and-final year of rental assistance can apply for a good cause exemption or extension during the online renewal. 
  •   CityFHEPS Case Changes: Clients can download the CityFHEPS modification form to report a change in their rent, household, or income.  
  •  Featured Updates in the ACCESS HRA Mobile Application: CityFHEPS case information, document status, and renewals are all fully integrated into the ACCESS HRA mobile application in addition to the client portal. 

   

Since the implementation of city-funded rental assistance in 2014, nearly 160,000 New Yorkers in over 70,000 households have been helped to move into permanent housing or remain stably housed. Currently, the CityFHEPS program alone supports 36,000 households by providing a rental subsidy.

The data doesn’t lie, and it gives me confidence in knowing that this administration is moving in the right direction. CITI BIKE EXPANSION IN THE BRONX

Citi Bike has been expanded in three phases. To encourage ridership in the most recent expansion area, Lyft (the operator of Citi bike) offers a 40% discount for new annual members, as well as other discounts for existing members and NYCHA residents/SNAP recipients. The deadline to register is December 31, 2023.
