THREE TEENAGE BOYS INDICTED FOR KILLING BYSTANDER AND WOUNDING FOUR PEOPLE IN SUBWAY SHOOTING

 

Defendants Are 14, 15 and 16 Years Old; They Fired at Least 19 Shots on Crowded Platform During Gang Shootout

Bronx District Attorney Darcel D. Clark announced that three Bronx teenagers have been indicted for second-degree Murder and additional charges for allegedly engaging in a shootout between their rival gangs at the Mount Eden Avenue subway station, killing a man and injuring four other people. 

District Attorney Clark said, “Once again we are talking about boys getting their hands on guns and destroying lives. The defendants allegedly fired their weapons during rush hour, on a busy platform, killing a man and seriously hurting four other people. They have also ruined their futures. This carnage must stop, and we all need to step up and make a difference before youths decide to pick up a gun.” 

District Attorney Clark said the defendants, Langel Jones, 16, a 15-year-old boy and a 14- year-old boy, all of the Bronx, were indicted on second-degree Murder, and variously charged with Attempted Murder in the second-degree, first degree Assault, second degree Assault, Attempted Assault first and second degree, Reckless Endangerment in the first and second degree, and second-degree Criminal Possession of a Weapon. They have all been arraigned before Bronx Supreme Court Justice Gayle Roberts and remanded. Jones’ case was adjourned to June 11, 2024, and the others are due back in court on June 6, 2024, and July 30, 2024. 

According to the investigation, on February 12, 2024, at approximately 4:35 p.m., at the Mount Eden subway station on the 4-train platform, the defendants acting in concert with each other allegedly fired at least 19 shots during the course of a shootout between the Davidson Avenue Boys Mac Ballers and the Burnside Money Getters. All three defendants allegedly possessed a gun and fired it during the shootout, resulting in the death of Beltran Sanchez, 35, who was shot in the chest. Four other straphangers suffered wounds ranging from being shot in the face, arm, foot, and hand. One of the juvenile defendants also suffered a gunshot wound.

District Attorney Clark also thanked NYPD Detectives Mark Buono, Robert Riley, Sean Kelly, Christopher Layton, Jose Mercedes, Carolyn Daley, of the 44 Precinct Detective Squad, and NYPD Police Officers Vincent Fortino, Michael Meneses, Xavier Perez, Nicholas Santomero, and Hanna Cottignies, of the 44 Precinct, NYPD Detectives Faton Alickaj, Brianna Constantino, Arelis Collazo of the Bronx Homicide Squad, NYPD Detective Lahman Sanders of the Regional Fugitive Task Force, and all responding members of the NYPD’s 44 Precinct and Transit District 11 for their work on the investigation.

An indictment is an accusatory instrument and not proof of a defendant’s guilt.

I do want to note, we're talking about women's health care, and our celebration here in New York, it's a little bit bittersweet because we know what we're doing here in the State of New York to protect women during pregnancy, new babies, making sure they're healthy, but also making sure that women have options, that reproductive choices are their own.

So, what is happening here is so different than what we're seeing across the nation. In the last 24 hours, we saw what happened in the State of Florida after a draconian abortion ban in a state that was one of the few refugees for people to go to who needed abortion services. And now that is basically gone. Six weeks, I’ll just crudely say, it's a joke. Most women do not know they're pregnant after six weeks. I certainly did not.

So, it's basically saying women have no rights to an abortion in the State of Florida. And this is not just for women who want to make decisions about when they want to time their families, but also women who may be desirous of a new baby and a healthy baby and circumstances of a change in a devastating way. Sometimes the cribs are already bought and the baby's room is painted and the showers are done and something takes a terrible turn of events. And we're also limiting women's options there as well. So, physicians in Florida are sounding the alarm that literally women's lives will be at risk.

On the other hand, we saw in Arizona a couple of outlier, brave Republicans, who crossed the line and voted with the Democrats to protect reproductive rights because as we know, the Republican-controlled State Court resurrected an abortion ban that was on the books since, yes, the Civil War. So, we're really hopeful, and the Governor of Arizona is a good friend of mine, and I know she'll do the right thing. So, at least there's a little bit of respite for the people in that state.

And then you also pay attention to the national news. Can't make this up, but Donald Trump said he supports prosecuting women who have an abortion. Yes, he said that. He won't rule out a national abortion ban, and he won't rule out banning IVF, which for so many families in this country is the only option they have to start a family that they want to have.

But we are in New York. We'll continue to stand tall, always be that safe harbor for women, and women in the State of New York know that as long as I'm their Governor, I will fight every battle that comes our way to ensure that these rights are protected here.


DEC Now Accepting Public Comments on Threatened and Endangered Species Regulations

The New York State Department of Environmental Conservation (DEC) today announced the start of a public comment period for threatened and endangered species draft regulations. While no specific substantial changes to existing threatened and endangered species protections are included in the rulemaking, DEC is accepting comments until July 16, 2024.

The proposed rulemaking reinstates regulatory language that was vacated as a result of a recent court ruling. The proposal would re-issue the entirety of the endangered and threatened species regulations as they existed prior to the 2022 court decision and provide for a public comment period and public hearing to restore the regulations to their previous form. There are no substantial changes to the regulations being made through this effort, beyond updating the dates to the most recent publication of federal regulations that are referenced within the regulations.

Comments will be accepted through close of business on July 16, 2024 and must be submitted in writing to wildliferegs@dec.ny.gov (subject: “Repromulgation”) or to: NYSDEC, Attn: Dan Rosenblatt, 625 Broadway, Albany, NY 12233-4754.

DEC is holding two virtual public hearing sessions on Tuesday, July 9, 2024 at 1 p.m. and 6 p.m. The draft regulations and details for the hearing and comment period are available on DEC's website at http://www.dec.ny.gov/regulations/propregulations.html#public.

The video also confirms that the NYPD made patently false statements about the shooting.

Attorney General James Releases Footage from Investigation into Death of Win Rozario

 

New York Attorney General Letitia James today released police body-worn camera footage that her office obtained as part of its ongoing investigation into the death of Win Rozario, who died on March 27, 2024 following an encounter with members of the New York City Police Department (NYPD) in Queens. 

On the afternoon of March 27, NYPD officers responded to a 911 call at 103rd Street and 101st Avenue in Queens. Upon arrival, officers encountered Mr. Rozario, who was allegedly holding a pair of scissors. Two officers fired their service weapons at Mr. Rozario. Mr. Rozario was transported to a local hospital, where he was pronounced dead. Officers recovered a pair of scissors at the scene.

The Office of Special Investigation (OSI) of the Attorney General’s Office released videos from body-worn cameras that the NYPD officers were equipped with during the incident. The release of these videos follows Attorney General James’ directive that camera footage obtained by her office in the course of an OSI investigation be released to the public in order to increase transparency and strengthen public trust in these matters.

Pursuant to New York State Executive Law Section 70-b, OSI assesses every incident reported to it where a police officer or a peace officer, including a corrections officer, may have caused the death of a person by an act or omission. Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed. Also, the decedent may or may not be in custody or incarcerated. If OSI’s assessment indicates an officer may have caused the death, OSI proceeds to conduct a full investigation of the incident.

The release of this footage is not an expression of any opinion as to the guilt or innocence of any party in a criminal matter or any opinion as to how or whether any individual may be charged with a crime.

MAYOR ADAMS ANNOUNCES CITY HAS SERVED OVER 750 FAMILY MEMBERS OF FATAL OVERDOSE VICTIMS THROUGH FIRST-IN-NATION SUPPORT PROGRAM

 

Builds on ‘HealthyNYC’ Goals to Reduce Opioid Overdose Deaths by 25 Percent by 2030

New York City Mayor Eric Adams and New York City Chief Medical Examiner Dr. Jason Graham today announced that the city has served more than 750 family members of fatal overdose victims through a first-in-the-nation support program through the New York City Office of the Chief Medical Examiner (OCME). Since launching in late 2022, OCME’s Drug Intelligence and Intervention Group (DIIG) — a unit staffed by trained social workers and public health professionals — has offered support to surviving family members and close contacts as they cope with pressing needs in the wake of the overdose deaths of loved ones. Nearly 80 percent of those contacted, over 750 people, accepted a wide range of services, including grief and bereavement support, mental health and substance use counseling, health care, and housing support. The DIIG program builds on the city’s work to reduce opioid deaths by 25 percent by 2030 as part of ‘HealthyNYC,’ Mayor Adams’ plan to extend the lifespan of all New Yorkers.

 

“As the fentanyl crisis continues to ravage communities across the country, New York City is taking action to save lives and support the loved ones who have been left behind,” said Mayor Adams. “New Yorkers who lose loved ones to drug overdoses need our help without stigma, and this first-in-the-nation model will deliver the support they deserve.”

 

“The medical examiner’s office interacts with New Yorkers at some of the most difficult moments in their lives,” said Deputy Mayor for Health and Human Services Anne Williams-Isom. “As we know in recent years, so many of those loved ones have been lost to the opioid crisis. The Drug Intelligence and Intervention Group is a team of social workers and public health professionals, one of the first models of its kind in the nation, that reach out to impacted family members and friends to provide support and a connection to a variety of services if needed. Thank you to Dr. Graham for his leadership and to the thoughtful and caring team at OCME.”

 

“The opioid crisis touches every community in our city, and fatal drug overdoses leave behind loved ones who often struggle in silence with unmet needs,” said Chief Medical Examiner Dr. Graham. “Our program recognizes the unique challenges facing this diverse population of New Yorkers, and evolves the role of the medical examiner to include making connections to care and services for surviving family members, with the aim of improving and even saving lives.”

 

“The overdose crisis has taken lives from our city and loved ones from our sides,” said New York City Department of Health and Mental Hygiene Commissioner Dr. Ashwin Vasan. “Supporting the loved ones of those we've lost, whether navigating the emotional impacts or accessing resources, is a valuable tool as we work together to foster a healthier New York City.”

 

Launched in late 2022 as the first initiative of its kind in a medical examiner’s office, DIIG has expanded from a small pilot to a fully staffed program focused on the wide-ranging needs of communities that have lost loved ones to fatal drug overdoses. The program currently reaches nearly 80 percent of the close contacts it attempts to reach. Reducing overdose deaths is central to “HealthyNYC,” the city’s ambitious health agenda that aims to increase the life expectancy of New Yorkers to 83 years by the year 2030. HealthyNYC was codified into local law last month. The major steps outlined in HealthyNYC build on the Adams administration’s efforts to create a healthier and safer city, including through programs like “Care, Community, Action: A Mental Health Plan for New York City” — the city’s plan to improve family and child mental health while addressing the overdose crisis — as well as Mayor Adams’ “Blueprint to End Gun Violence.
