LEGISLATION & ADVOCACY
Governor Hochul Cracking Down on Retail Theft

Governor Hochul is proposing a comprehensive plan to tackle property crime, provide relief to small businesses, and bring peace of mind to New Yorkers while they shop.

Across the state, property crime has risen exponentially since the pandemic. From January to June 2023, larceny in New York City was up 12 percent over the same period in 2022 and up 58 percent compared to the first six months of 2017. In the rest of the state, although 2 percent down from 2017, larceny has risen 3 percent year over year, trending upward.

As a result, business owners and retail workers are facing increased stress and financial strain, and New Yorkers are concerned and frustrated running simple errands at a local pharmacy, grocery store or retail shop.

New York City Council Vote on Vending Bill Package

New York City Council plans to vote on the vending bill package on February 8, 2024. The vending bill package up for voting includes the following:

T2024-0071: Prohibiting vending on a bridge approach
T2024-0073: Prohibiting vending or vendor-related activity in bicycle lanes
T2024-0070: Vendor display of goods and repeal of bookkeeping requirements
T2024-0069: Elimination of the requirement that individual employees of food vendors obtain a certificate of authority to collect sales tax
T2024-0075: Permits street vendors to vend within two feet from the curb or as close as possible to an obstruction
T2024-0074: Repealing misdemeanor criminal penalties for general and food vendors
Bill Hearing on E-Bike Safety

This bill would establish safety standards for powered bicycles and powered mobility devices when used for food delivery services.

Specifically, the bill requires that any powered mobility device operated by a food delivery worker on behalf of a third-party delivery service or third-party courier service meet local standards established for the sale of such device, which includes certification by an accredited testing laboratory. Third-party delivery services or third-party courier services would be responsible for providing food delivery workers with such devices at no expense to the worker.

Finally, responsibility for compliance with these provisions would fall on the third-party delivery service or third-party courier service, which would be subject to civil penalties for any violations.

Implementation of Commercial Waste Containerization

As part of our commitment to keeping our streets clean, the NYC Department of Sanitation (DSNY) is implementing new rules to reduce the number of black bags that line city streets.

DSNY began this process in April 2023, when we changed the waste setout times for residents and businesses — reducing the time trash, recycling, and curbside composting will sit on sidewalks.

Starting March 1, 2024, ALL businesses in NYC must use bins with secure lids when setting out trash for collection.
