Defendant Alerted Shooters that Boys Were There; They Were Allegedly Targeted for Disrespecting “1300” Crew
Bronx District Attorney Darcel D. Clark today announced that a Bronx woman has been indicted for Attempted Murder and related charges in the shooting of two boys at a McDonald’s in the Allerton section last summer.
District Attorney Clark said, “The defendant’s actions allegedly led to the shooting of a 12-year-old boy and a 13-year-old boy while putting the lives of restaurant workers and customers at risk. Thankfully no one was gravely injured in this act of senseless violence.”
District Attorney Clark said Diamond Smith, 18, of East 221st Street, the Bronx, was indicted for acting in concert on two counts of Attempted Murder, first-degree Criminal Use of a Firearm, four counts of Attempted Assault in the first degree, two counts of second-degree Assault, two counts of Attempted Assault in the second-degree, two counts of second-degree Criminal Possession of a Weapon, Criminal Possession of a Firearm, fourth-degree Criminal Possession of a Weapon, and two counts of Endangering the Welfare of a Child before Bronx Supreme Court Justice Kim Parker. Bail was set at $75,000 cash/$500,000 bond/$500,000 partially secured at 10% plus an examination of surety. She is due back in court on June 27, 2025
According to the investigation, on July 6, 2024, at approximately 10:00 p.m., the victims, ages 12 and 13, were eating at a McDonald’s on White Plains Road near Mace Avenue in the Allerton neighborhood. The defendant was at the restaurant and saw the boys, whom she believed were rival street crew members. She allegedly alerted Dreshawn Lucas, 21, who allegedly drove Waynol Recio, 19 to the restaurant. Recio allegedly opened fire at the boys, wounding the younger child in the leg, the back, and the buttocks. The 13-year-old was shot once in the leg.
Recio and Lucas have been indicted on the same charges.
District Attorney Clark thanked NYPD Detectives Alisa Colon of the 49th Precinct Squad, and Robert Altieri of the Gun Violence Suppression Division for their work on the case.
An indictment is an accusatory instrument and not proof of a defendant’s guilt.
