Former Venezuelan General Pleads Guilty To Narco-Terrorism, Weapons, And Drug Trafficking Charges

 

The United States Attorney for the Southern District of New York, Jay Clayton, and the Acting Administrator of the U.S. Drug Enforcement Administration (“DEA”), Robert Murphy, announced that former Venezuelan general HUGO ARMANDO CARVAJAL BARRIOS, a/k/a “El Pollo,” pled guilty before U.S. District Judge Alvin K. Hellerstein to conspiracy to import cocaine into the United States, engaging in narco-terrorism for the benefit of the Fuerzas Armadas Revolucionarias de Colombia (the “FARC”), and related weapons offenses. 

“The deeply troubling reality is that there are powerful foreign government officials who conspire to flood the United States with drugs that kill and debilitate,” said U.S. Attorney Jay Clayton. “Hugo Armando Carvajal Barrios was once one of the most powerful men in VenezuelaFor years, he and other officials in the Cartel de Los Soles used cocaine as a weapon—flooding New York and other American cities with poisonIn doing so, Carvajal Barrios partnered with a deadly terrorist group to support their combined drug trafficking and terrorism efforts, wreaking havoc on communities throughout the United States and elsewhere. This guilty plea demonstrates our commitment to holding accountable foreign officials who abuse their power to poison our citizens.  I commend the extraordinary efforts of our law enforcement allies in the DEA’s Special Operations Division and our other law enforcement partners here and abroad.” 

“Hugo Armando Carvajal Barrios exploited his position as the director of Venezuela’s military intelligence and abandoned his responsibility to the people of Venezuela in order to intentionally cause harm to the United States,” said DEA Acting Administration Robert Murphy.  “After years of trying to evade law enforcement, Carvajal Barrios will now likely spend the rest of his life in federal prison. As evidenced in this case, DEA will relentlessly pursue anyone who uses violence, drugs, and intimidation to compromise the safety and security of the United States.”  

As alleged in the Superseding Indictment, other court filings, and statements made during court proceedings:

Beginning in at least 1999, CARVAJAL BARRIOS, a Venezuelan citizen and the former director of Venezuela’s military intelligence agency, which was known as the Direccion de Inteligencia Militar (“DIM”), along with other high-ranking Venezuelan government and military officials, acted as leaders and managers of the Cartel de Los Soles, or “Cartel of the Suns.”  CARVAJAL BARRIOS and other Cartel de Los Soles members abused the Venezuelan people and corrupted the legitimate institutions of Venezuela—including parts of the military, intelligence apparatus, legislature, and judiciary—to facilitate the importation of tons of cocaine into the United States.  The Cartel de Los Soles sought not only to enrich its members and enhance their power but also to “flood” the United States with cocaine and inflict the drug’s harmful and addictive effects on users in the United States.  To accomplish these goals, the leaders of the Cartel de Los Soles partnered with leaders of the FARC, a violent terrorist organization based in Colombia that was dedicated to the overthrow of the Colombian government, which was responsible for the production and distribution of the majority of the cocaine that reached the United States.

CARVAJAL BARRIOS held multiple positions of public trust in Venezuela that he exploited to benefit the Cartel de Los Soles, including as director of the DIM between approximately 2004 and 2011, and again in 2013.  CARVAJAL BARRIOS took advantage of that position to illegally traffic narcotics and support his drug trafficking partners, including the FARC.  In or about 2006, for example, CARVAJAL BARRIOS coordinated with other members of the Cartel de Los Soles to dispatch a 5.6-ton cocaine shipment from Venezuela on a DC-9 plane bearing a United States registration number.  The plane departed Venezuela and landed in Mexico, where Mexican authorities seized the 5.6 tons of cocaine upon arrival.  CARVAJAL BARRIOS also worked with the FARC to coordinate multi-ton drug shipments under his protection; provided heavily-armed security to protect drug shipments; and armed the FARC with automatic weapons and explosives to further the group’s drug trafficking and terrorist activities.  To accomplish cocaine distribution on this massive scale, CARVAJAL BARRIOS accepted millions of dollars from drug traffickers.  In addition, CARVAJAL BARRIOS participated in violence, including kidnappings and murder, to facilitate this cocaine trafficking and protect his co-conspirators.

One of CARVAJAL BARRIOS’s co-defendants in this case has already been sentenced.  On or about April 11, 2024, Cliver Antonio Alcala Cordones was sentenced principally to a term of 260 months in prison, after pleading guilty to providing material support, including firearms, to the FARC.  Other co-conspirators remain at large.

CARVAJAL BARRIOS, 65, of Venezuela, pled guilty to four counts contained in the Superseding Indictment. A table containing the charges and minimum and maximum penalties is set forth below.  CARVAJAL BARRIOS is scheduled to be sentenced on October 29, 2025.

The minimum and maximum potential sentences in this case are prescribed by Congress and provided here for informational purposes only, as any sentencing will be determined by the judge.

Mr. Clayton praised the outstanding efforts of the DEA’s Special Operations Division Bilateral Investigations Unit, Miami Field Division, New York Field Division, Madrid Country Office, Bogota Country Office, and Mexico City Country Office; the Department of Homeland Security, Homeland Security Investigations; the U.S. Treasury Department, Office of Foreign Assets Control; the Counterterrorism Section of the Department of Justice’s National Security Division; the Narcotic and Dangerous Drug Section of the Department of Justice’s Criminal Division; the U.S. Attorney’s Office for the Southern District of Florida; the Department of Justice’s Office of International Affairs; the U.S. Embassy Madrid; the U.S. Embassy Bogota; the U.S. Embassy Mexico City; and our law enforcement partners in Colombia, Mexico, and Spain.

The Justice Department’s Office of International Affairs provided significant assistance in securing the arrest and July 19, 2023, extradition from Spain of Carvajal Barrios.

This prosecution is part of an Organized Crime Drug Enforcement Task Force (“OCDETF”) operation. OCDETF identifies, disrupts, and dismantles the highest-level criminal organizations that threaten the United States using a prosecutor-led, intelligence-driven, multi-agency approach.

Second Owner of Fuel Truck Supply Company Incarcerated for Bid Rigging, Market Allocation, and Wire Fraud Conspiracies

 

The owner of a fuel truck supply company, Kris Bird, 62, was sentenced in Boise, Idaho, to three months in prison and a $24,000 fine for his role in schemes to rig bids, allocate territories, and commit wire fraud over an eight-year period. Further, Bird was ordered to forfeit to the federal government $1,542,387 as proceeds of his wire fraud offenses. The conspiracies Bird participated in related to contracts to provide fuel trucks that assist the U.S. Forest Service’s efforts to battle wildfires in Idaho and the mountain west.

Bird pleaded guilty in March 2025 — two weeks before his trial was set to begin — to the seven-count indictment. The plea followed an investigation that involved evidence from a judicially authorized wiretap and led to charges against two executives in December 2023. Earlier this month on June 5, Bird’s co-defendant, Ike Tomlinson, 61, was sentenced to 12 months in prison and a $20,000 fine for his leadership role in the criminal conduct.

“Mr. Bird stole taxpayer funds allocated for critical wildfire-fighting efforts protecting the American people to line his own pockets,” said Assistant Attorney General Abigail Slater of the Justice Department’s Antitrust Division. “The Trump Antitrust Division’s Procurement Collusion Strike Force and its law enforcement partners will continue the fight to ensure that the fraudulent use of taxpayer money results in incarceration.”

“This sentencing underscores the FBI’s commitment to protecting the integrity of our markets,” said Assistant Director Jose A. Perez of the FBI Criminal Investigative Division. “Antitrust violations are not just corporate misconduct, they’re federal crimes that distort competition, drive up costs for consumers and erode public trust. We will continue to work with our law enforcement and regulatory partners to hold accountable those who rig the system for personal gain.”

“Bid rigging is not a victimless crime. It cheats taxpayers and the honest contractors who play by the rules,” said Assistant Inspector General for Investigations Jason Suffredini of the General Services Administration (GSA) Office of Inspector General (OIG). “GSA OIG and our partners remain committed to pursuing those who engage in procurement fraud.”

According to court documents, the co-conspirators coordinated their bids to inflate prices and to determine who would have priority to receive business from the U.S. Forest Service and other federal agencies in the event of a wildfire in a specific geographic area. The co-conspirators further coordinated to exclude and punish potential competitors to further maintain the success of their conspiracy. During the conspiracies, from March 2015 to March 2023, Bird annually submitted false SAM certifications to the federal government covering up his bid-rigging conspiracy and committing wire fraud. 

The Antitrust Division’s San Francisco Office, U.S. Attorney’s Office for the District of Idaho, FBI Salt Lake City Field Office, Boise Resident Agency, and General Services Administration Office of Inspector General investigated the case. Assistant Chief Christopher J. Carlberg and Trial Attorneys Elena A. Goldstein, Daniel B. Twomey, and Matthew Chou of the Antitrust Division's San Francisco Office, and Assistant U.S. Attorney Sean M. Mazorol for the District of Idaho have been prosecuting the case.

In addition to this criminal sentence, in May 2025, the United States, on behalf of the U.S. Forest Service, U.S. Bureau of Land Management, and the U.S. Small Business Administration, entered into a civil settlement with Kris Bird and other related entities and individuals who agreed to pay $781,186 to resolve civil claims after admitting to allegations that they obtained government contracts through bid-rigging and the submission of false SAM Certifications, as well as wrongly obtained a Paycheck Protection Program loan.

The U.S. Attorney’s Office for the District of Idaho and the U.S. Department of Agriculture Office of Inspector General investigated the civil case. Assistant United States Attorney Robert B. Firpo and Civil Chief James Schaefer are handling the case.

DEC Launches New Water Grants Data Portal

Interactive Web-Based Mapper Displays Grant-Funded Projects

New York State Department of Environmental Conservation (DEC) Commissioner Amanda Lefton launched the DEC Division of Water Grants Data Portal, an interactive web-based mapper that contains a comprehensive dataset of grants awarded to water quality and habitat projects. This innovative streamlined portal with enhanced access to grants data, now provides municipalities, Soil and Water Conservation Districts, and the general public a better understanding of the massive scale of New York State’s investments in water quality and habitats. 

“DEC’s new Division of Water Grants Data Portal allows interested New Yorkers to learn more about $1.7 billion in investments dating back nearly 30 years from two of DEC’s most impactful water grant programs,” Commissioner Lefton said. “The streamlined mapper offers quick and easy access to water quality grant data and is a beneficial way for everyone to see how, when, and where New York State is working to improve water quality and reduce flood risk across the state. As part of DEC’s mission to serve the public, users can filter and download information from more than 2,100 projects that are reducing water pollution, restoring aquatic habitat, and increasing resilience to serious storms today and future climate challenges.” 

The mapper lists projects funded through the Water Quality Improvement Project (WQIP) program and Non-Agricultural Nonpoint Source Planning and MS4 Mapping Grant (NPG) programs. The grant programs are currently open for a new round of applications through the Consolidated Funding Application (CFA). Applications are being accepted through July 31, 2025, at 4 p.m. At least $75 million is available through the WQIP Grant Program and up to $3 million is available through the NPG Grant Program

Nine different project types are available for funding through WQIP, including Wastewater Treatment Improvement, Non-agricultural Nonpoint Source Abatement and Control, Vacuum Trucks for Municipal Separate Storm Sewer Systems (MS4) Areas, Land Acquisition for Source Water Protection, Salt Storage and Road Salt Reduction, Dam Safety Repair/Rehabilitation and Dam Removal, Aquatic Connectivity, Marine District Habitat Restoration, and Fish and Wildlife Habitat Restoration and Enhancement. 

Municipalities, including Indian Nations, are eligible to apply for all project types. Soil and Water Conservation Districts and not-for-profit organizations are eligible for select project types. Maximum grant awards range from $100,000 to $15 million depending on the project type and population served, as identified in the request for applications. NPG funds the production of planning reports for nonpoint source water quality improvement projects and mapping of MS4 areas. 

Seventeen eligible planning report types, including stream culvert repair and replacement, green infrastructure, and wetland restoration, are available for funding. DEC also added planning report types to include winter road maintenance, sanitary survey for alternative waste management, and riparian corridor restoration and enhancement.

New York's Commitment to Water Quality 

New York State continues to increase its nation-leading investments in water infrastructure. With $500 million allocated for clean water infrastructure in the recently Enacted 2025-26 State Budget, New York will have invested a record $6 billion in water infrastructure since 2017. The budget also included an increase to the Environmental Protection Fund for a record total of $425 million. Initiatives in Governor Hochul’s State of the State are ensuring ongoing coordination with local governments and helping communities to leverage these investments. Governor Hochul announced $435 million in grants to 102 projects in November, featuring increased awards for wastewater projects for smaller, disadvantaged communities. The Governor also expanded the State Environmental Facilities Corporation’s (EFC) Community Assistance Teams to help small, rural and disadvantaged communities leverage this funding and address their clean water infrastructure needs. Any community needing assistance with water infrastructure projects is encouraged to contact EFC.

The Consolidated Funding Application was created to streamline and expedite the grant application process. The CFA process marks a fundamental shift in the way state resources are allocated, ensuring less bureaucracy and greater efficiency to fulfill local economic development needs. The CFA serves as the single-entry point for access to economic development funding, ensuring applicants no longer have to slowly navigate multiple agencies and sources without any mechanism for coordination. Now, economic development projects use the CFA as a support mechanism to access multiple state funding sources through one application, making the process quicker, easier, and more productive. STATEMENT FROM STATE SENATOR GUSTAVO RIVERA ON SEN. GILLIBRAND'S COMMENTS ON THE BRIAN LEHRER SHOW

 

Today, State Senator Gustavo Rivera released the following statement in response to comments made by Senator Kirsten Gillibrand on The Brian Lehrer Show. 


"Yesterday, Senator Gillibrand made a slew of untrue statements on the Brian Lehrer show about Zohran Mamdani, while repeating talking points that were based in misinformation and Islamophobia. 

"I understand that Senator Gillibrand is attempting to acknowledge Jewish New Yorkers’ struggle with rising hate crimes, violence, and fear. However, in a state as diverse as ours, I am deeply appalled that Senator Gillibrand would be so carelessly divisive in making such baseless and racist accusations against Zohran Mamdani. 

"Mr. Mamdani has been clear that he shares Senator Gillibrand’s concern about antisemitism and he has repeatedly affirmed his commitment to the safety of Jewish New Yorkers. He backs that up with a pledge to increase funding for hate crime prevention, an investment that will keep all New Yorkers safe. 

"It is unacceptable to hear a US Senator and other elected officials amplify Islamophobic attacks and fearmongering against Muslim New Yorkers. Her dishonesty further fans the flames that Trump and MAGA Republicans are already stoking.

"New York City democrats made their decision last Tuesday to overwhelmingly back Zohran Mamdani, not because they agreed with him on every single policy position and opinion, but because of his vision for a safer and more affordable city for working families. We should be coalescing behind him and engaging in respectful, truthful dialogue, not airing divisive MAGA lies. 

"Senator Gillibrand must immediately apologize."

No one has won the Democratic primary for mayor according to the Board of Elections. That will be decided on July 1, 2025 when Rank Choice Voting is finalized since no candidate received over 50% of the vote. 

Permits Filed for 885 Fox Street in Woodstock, The Bronx

 


Permits have been filed for a seven-story residential building at 885 Fox Street in Woodstock, The Bronx. Located near the intersection of Fox Street and Tiffany Street, the lot is near the Hunts Point Avenue subway station, served by the 6 train. Remzi Kurbogaj of R&A Remodeling LLC is listed as the owner behind the applications.

The proposed 67-foot-tall development will yield 15,011 square feet designated for residential space. The building will have 25 residences, most likely rentals based on the average unit scope of 600 square feet. The masonry-based structure will also have a 17-foot-long rear yard.

Chad Firmstone of C2B Architects is listed as the architect of record.

Demolition permits were filed in April for the three-story structure on the site. An estimated completion date has not been announced.

STATE SENATOR GUSTAVO RIVERA AND ASSEMBLYMEMBER JOHN ZACCARO JR. ANNOUNCE FUNDING FOR BRONX HOUSE AFTERSCHOOL PROGRAM


State Senator Gustavo Rivera was honored to present a check for $250,000 to Bronx House to keep the doors open for the afterschool program next school year.


Senator Rivera and Assemblymember John Zaccaro Jr. joined Bronx House staff, children and families from this great program to celebrate the end of the school year and the $500,000 secured to ensure families can access high quality after school in their own neighborhood. Senator Rivera gave brief remarks about the importance of securing funding for organizations that support our borough’s youth and that do exemplary work in his district. 


“I’m incredibly proud of the half a million dollars that Assemblymember Zaccaro Jr. and I secured for Bronx House’s after school program," said State Senator Gustavo Rivera. “With the cost of childcare continuing to rise, this substantial funding will keep this vital program running, which in turn, will ensure that countless parents in our community and their children continue to enjoy the resources and services offered by this program. I want to thank Executive Director Howie Martin for his advocacy and partnership in this process. I am committed to helping organizations such as Bronx House that offer essential services to our neighbors.”


Bronx House’s after school program "aims to help improve children’s academic performance, as well as promote healthy lifestyles, social skills, literacy skills, and service to the community.” This funding will undoubtedly have a positive impact on the Bronx House community, especially our children.
