State Senator Gustavo Rivera On the Legionnaires Disease Outbreak in the South Bronx

GOVERNMENT HEADER

“My heart goes out to the families and loved ones of the ten South Bronx residents who were diagnosed with Legionnaires’ disease and the one person who tragically died. I am deeply concerned that there is another outbreak in The Bronx with preliminary detection of Legionella bacteria in 10 cooling towers across the affected neighborhoods.

I am closely monitoring the City’s investigation and response as we await test results to determine whether live bacteria were present and if these towers are connected to the current outbreak. Every property owner must be held accountable for complying with New York City’s cooling tower testing and maintenance requirements to prevent the spread of Legionella. Cooling towers that require remediation must be cleaned and disinfected without delay. The fact that two of the towers identified by the City Health Department did not provide required testing information warrants immediate scrutiny. Recent outbreaks across New York City underscore the importance of proactive public health action by responsible parties.

If you live or work in zip codes 10451 and 10456, please take note that Legionnaires' disease symptoms include fever, chills, muscle aches, and cough. People may also have headaches, fatigue, loss of appetite, confusion, or diarrhea. If you have these symptoms, seek medical attention. It is especially important for people at increased risk for Legionnaires' disease to seek care right away. Contact your healthcare provider if you are worried about Legionnaires’ disease.

On National Voter Registration Day, Commission on Government Efficiency Launches Public Education Campaign on Ballot Props 1-5

“Vote on Faster Government” PSAs and information hub will help ensure New Yorkers know about props 1-5 this November

The Commission on Government Efficiency (COGE), the 2026 New York City Charter Revision Commission convened by Mayor Zohran Kwame Mamdani, today launched “Vote on Faster Government,” a public education campaign to inform New Yorkers about the five ballot proposals that will appear on the November ballot.

The campaign includes a public education video and online information hub (nyc.gov/fast), with citywide PSAs launching next month. COGE will also hold briefings with stakeholders, engage community leaders through speaking engagements and roundtables, distribute educational materials directly to voters and use digital outreach to encourage New Yorkers to make their voices heard at the ballot box.

“More than 1,000 New Yorkers participated in public hearings this summer, sharing ideas not just about what government does but about how it does it,” said Ann Cheng, Executive Director of the Commission on Government Efficiency. “The Vote on Faster Government campaign brings this work back to where it started: with New Yorkers and their ideas for a more efficient government. In the weeks ahead, COGE will work tirelessly to ensure New Yorkers know what these five proposals would do long before they enter the voting booth.”

“Whether you bike to work, own a small business or rely on non-profit services, these ballot proposals are about making sure City government works more efficiently for you,” said Patrick Gaspard, Chair of the Commission on Government Efficiency. “New Yorkers have been at the very center of this process from the beginning. We listened to their experiences, brought their ideas together, and advanced five ballot proposals. Now it’s up to voters to decide. Until then, our job is to make sure every voter has what they need to make an informed choice.”

Starting September 15, the Vote on Faster Government campaign will reach New York City voters through:

  • An online information and resource hub
  • PSAs and digital advertising
  • Briefings with community leaders and critical stakeholders, including New Yorkers who participated in public hearings
  • Digital engagement and mobilization efforts
  • Direct grassroots outreach and canvassing
  • Palm cards and educational materials in 13 languages

The Five Ballot Proposals

In July, following 10 public hearings, COGE voted to advance ballot proposals to New York City voters.

Question 1 saves small businesses time and money by making it easier to open outdoor dining and build accessible ramps.

  • Cuts the outdoor dining application process by 75%, from eight months to two months
  • Saves small businesses up to $1,800 in application costs and thousands of dollars in staff time
  • Speeds up the approval process for accessible entrance ramps and lifts by two months

Question 2 speeds up City contracting so small businesses and nonprofits can deliver services more quickly.

  • Reduces administrative burdens on small businesses and nonprofits that contract with the City
  • Saves City contractors like small businesses and nonprofits up to 30 days in the contracting process

Question 3 fast-tracks street safety projects and generates revenue from surplus City property.

  • Speeds up street safety projects, including bike lanes, by at least 33%
  • Unlocks more than $200 million in potential City revenue through the sale of small surplus lots and unused air rights over City-owned landmarks

Question 4 simplifies construction permitting to speed up housing.

  • Brings 40 approvals from 18 separate offices and agencies into one place, saving builders time and frustration

Question 5 sets a rainy-day savings target to strengthen the City’s long-term fiscal stability

  • Establishes a savings target of 12% of total tax revenue to help strengthen the City’s financial position over the long term

Abbott Agrees to Pay Over $384M to Settle Allegations Related to Contaminated Infant Formula

The Department’s Resolution Delivers Accountability and Sends a Clear Message That America’s Food Supply Is Nonnegotiable

Abbott Laboratories (Abbott), an Illinois-based healthcare company that manufactures and sells infant formula and nutritional therapy products, has agreed to pay $384,999,040 to resolve allegations that it caused false claims to be submitted between Jan. 1, 2018, and Dec. 31, 2022, to federal and state programs arising from its failure to manufacture certain powder infant formula and nutritional therapy products at its Sturgis, Michigan, and Casa Grande, Arizona, facilities in compliance with federal and state statutory, regulatory, and contractual requirements.

On Nov. 13, 2025, the United States filed its Complaint in Intervention alleging that Abbott caused government programs to purchase powder infant formula manufactured at the Sturgis facility despite the products’ failure to meet statutory, regulatory, and contractual requirements. The Complaint alleged that Abbott knowingly manufactured infant formula purchased with taxpayer dollars in an environment that put the products at unacceptable risk of microorganism contamination and significantly impacted the products’ reliability, quality, and safety.

“This settlement is a victory for American families and makes clear the safety of our children is not negotiable,” said Acting Deputy Attorney General Trent McCotter.  “Abbott will pay a substantial sum to resolve serious allegations it violated federal health and safety requirements designed to protect babies. The Justice Department will act decisively against anyone who puts American families at risk and ensure misconduct carries serious consequences.”

“No company should be gambling on the health and safety of our Nation’s infants by allowing unsanitary conditions to persist at a facility manufacturing baby formula,” said Associate Attorney General Stanley E. Woodward, Jr. “The Department will hold accountable bad actors that knowingly misrepresent compliance with essential health and safety standards designed to protect American families.”

“It is critical that infant formula manufacturers adhere to regulatory and contractual requirements to ensure that the products they manufacture are safe for the babies who consume them,” said U.S. Attorney Timothy VerHey for the Western District of Michigan. “This settlement demonstrates our commitment to holding manufacturers accountable when the United States pays for noncompliant products.”

“Parents rely on companies like Abbott Laboratories to responsibly follow the rules and ensure their products – especially baby formula – are safe. USDA OIG remains vigilant against those that would compromise public health and safety by failing to comply with legal standards and put infants at risk,” said USDA Inspector General John Walk.  “This behavior is inexcusable and will not be condoned.”

As described in the complaint, roof leaks were a common occurrence in the Sturgis plant, leading to water running and dripping over equipment. Rather than permanently addressing the root causes, Abbott used temporary solutions, such as roof leak umbrellas, to try to divert leaks in product processing areas even though Abbott corporate leadership understood that the wet environment put the products at increased risk of microorganism contamination.  Similarly, the complaint alleged that Abbott continued to run spray dryers, where liquid formula was transformed into a dry powder, even after Abbott documented cracks and pits in the dryers, which also increased the risk of “micro” contamination, particularly in the presence of moisture.

Further, the Department alleged that Abbott made its spray dryer conditions worse by lengthening the number of product batches that passed through the dryers between cleaning cycles — enabling Abbott to increase production. The complaint also alleges that Abbott intentionally did not test for bacterial growth to avoid obtaining positive test results showing contamination, and that in certain instances where testing demonstrated “micro” contamination, Abbott failed to disclose the test results when responding to requests from FDA during 2019 and 2022 inspections at the Sturgis facility.

Under the civil settlement agreement, Abbott will pay $348,700,868 to the United States to resolve the False Claims Act allegations and an additional $36,298,172 to certain States for claims settled by their State Medicaid and WIC programs.

The U.S. Department of Agriculture funds and regulates the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) program, which provides nutritional support — including infant formula — to eligible participants. More than half of all infant formula purchased in the United States is paid for with USDA funds through WIC. State Medicaid Programs also cover and pay for certain infant formula.

The civil settlement resolves claims brought under the False Claims Act’s qui tam provisions, which allow private individuals to bring suit on behalf of the United States for false claims submitted to federal programs and to share in any recovery. Relators Scott Millard, Kristine Cooper, and Loren Cooper, who were Abbott employees, will receive $69 million as their share of the federal settlement. The qui tam action, filed in the United States District Court for the Western District of Michigan, is captioned United States, et al., ex rel. Scott Millard, et al., v. Abbott Laboratories, No. 1:22-cv-994 (W.D. Mich.).

The resolution was the product of a coordinated effort by the Justice Department’s Civil Division, Commercial Litigation Branch, Civil Fraud Section, and the U.S. Attorney’s Office for the Western District of Michigan, with assistance from USDA’s Office of Inspector General.

This year, the Trump Administration launched the Task Force to Eliminate Fraud and the National Fraud Enforcement Division to enhance the Administration’s war on fraud, waste, and abuse in federal programs. When unscrupulous actors exploit these programs for their own financial gain, they defraud the government, harm the people these programs are designed to aid and protect, and undermine American businesses that play by the rules. The Civil Division’s False Claims Act enforcement plays a critical role in combatting such fraudulent schemes, recovering billions of dollars for the American taxpayers, and holding wrongdoers accountable. False Claims Act matters will continue to be on the forefront of the battle against fraud, and the Civil Division’s False Claims work will support and advance the mission of the Task Force to Eliminate Fraud and the National Fraud Enforcement Division.

The matter was handled by Civil Fraud Section Trial Attorneys Asha Natarajan and Erin Colleran of the Justice Department’s Civil Division and Assistant U.S. Attorneys Whitney Schnurr and Jacob Carlton for the Western District of Michigan.

The claims resolved by the settlement are allegations only and there has been no determination of liability.

Attorney General James Calls on Congress to Preserve States’ Ability to Protect Americans from Cryptocurrency Scams

The Clarity Act Would Jeopardize State Attorneys General’s Ability to Protect Investors from Scams and Frauds

New York Attorney General Letitia James led a bipartisan coalition of 17 other attorneys general in opposing the Digital Asset Market Clarity Act (Clarity Act). In a letter sent to Senators Tim Scott and Elizabeth Warren, Chair and Ranking Member of the U.S. Senate Committee on Banking, Housing, and Urban Affairs, Attorney General James and the coalition warn that the Clarity Act would jeopardize their ability to protect investors from rampant digital cryptocurrency fraud and scams. The attorneys general caution that as written, the Clarity Act would prevent states from serving as the first line of defense against the escalating epidemic of cryptocurrency fraud.

“My office has proudly led the fight to protect New Yorkers and all Americans from rampant cryptocurrency fraud,” said Attorney General Letitia James. “As written, the Clarity Act would embolden scammers and potentially strip attorneys general of our authority to protect our states’ investors and their wallets. Together with my attorney general colleagues, I urge Congress not to pass the Clarity Act.”

The Office of the New York Attorney General (OAG) leads the nation in holding crypto companies accountable for failing to protect investors from scams. In 2019, Attorney General James brought the first and only enforcement action against the largest stablecoin issuer, Tether, for recklessly and unlawfully covering up massive financial losses from investors. The OAG has secured billions of dollars in refunds and fines from major crypto brokers that violated NY law or failed to protect investors from scams, including Coin Café, Gemini, Genesis, and KuCoin. The OAG has also worked with federal counterparts to secure major victories on behalf of fraud victims including in cases brought against GTV, Nexo, and Blockfi.

The Federal Bureau of Investigation (FBI) reported $11.4 billion in losses from complaints involving cryptocurrencies in 2025, an increase of 22 percent from 2024, with an average reported loss of $62,604. The Federal Trade Commission (FTC) has reported $1.78 billion in losses from complaints involving cryptocurrencies in 2025, a 25.6 percent increase from 2024. In New York, complaints to the OAG regarding crypto scams have tripled over the last three years, and crypto scam losses reported to the OAG totaled nearly half a billion dollars over the last five years.

The financial impact of crypto scams on victims can be devastating. In its present form the Clarity Act would muddy the waters, making it harder for OAG—and attorneys general nationwide—to continue efforts to crack down on cryptocurrency scams and hold platforms that violate the law accountable. The Clarity Act would also allow the Securities and Exchange Commission (SEC) to preempt state registration authorities. This unprecedented grant of authority would not only apply to digital assets but would also broadly grant unilateral discretion to SEC to reset the scope of federal preemption, potentially upending the state securities regulatory regime. The attorneys general assert that Congress should not cede such significant power to SEC.

State enforcement powers have been a critical weapon in fighting the crypto fraud epidemic. Since 2017, states have brought over 330 anti-fraud enforcement actions against scammers in the crypto ecosystem, shutting down fraudulent websites and schemes, securing justice for victims, and prioritizing cases where victims had no federal or private recourse.

Maintaining state oversight of the cryptocurrency industry is critical to protect consumers and investors. In their letter, the attorneys general advocate for legislation that would:

  • Preserve states’ enforcement role for both tokenized and non-tokenized securities;
  • Preserve cooperation between the federal government and the states;
  • Codify states’ role as regulators of cryptocurrencies and preserve their registration regimes that require crypto platforms to certify with states; and
  • Clarify ambiguous language that could otherwise embolden bad actors and lead to legal battles over enforcement.

Joining Attorney General James in sending the letter to Congress are the attorneys general of Arizona, California, Connecticut, Delaware, Illinois, Kansas, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, Ohio, Virginia, Washington, Wisconsin, and the District of Columbia.

Homeland Security Task Force Operation Leads to Three Luzerne County Men Convicted of Drug Trafficking Offenses

The United States Attorney’s Office for the Middle District of Pennsylvania announced that Jerrod Curtis, age 42, Paul Daniel Chavis, a/k/a “Payne,” age 56, and Reneard Harris, age 68, all of Wilkes-Barre, Pennsylvania, were convicted on September 10, 2026, for conspiracy to distribute controlled substances and other drug trafficking offenses following a two-week trial before United States District Judge Joseph F. Saporito, Jr.

According to United States Attorney Brian D. Miller, Curtis operated a drug-trafficking organization from his barbershop in Wilkes-Barre, PA.  Between February of 2024 through June of 2024, he and the other defendants conspired to distribute large amounts of controlled substances, including cocaine, cocaine base, methamphetamine, and fentanyl.  The jury further found that defendants committed the following criminal offenses during the course of the conspiracy:

  • On January 22, 2025, Chavis distributed and possessed with intent to distribute five grams and more of actual methamphetamine;
  • On April 15, 2025, Chavis distributed and possessed with intent to distribute a quantity of methamphetamine;
  • On April 19, 2025, Curtis and Harris used a communication facility to facilitate the commission of a drug trafficking crime; and
  • On April 30, 2025, and May 26, 2025, Curtis used a communication facility to facilitate the commission of a drug trafficking crime.

During the investigation, DEA and other law enforcement agents recovered over 10 kilograms of fentanyl from members of the conspiracy as well as large quantities of other controlled substances.

This operation is part of the Homeland Security Task Force (HSTF) initiative established by Executive Order 14159, Protecting the American People Against Invasion. The HSTF is a whole-of-government partnership dedicated to eliminating criminal cartels, foreign gangs, transnational criminal organizations, and human smuggling and trafficking rings operating in the United States and abroad. Through historic interagency collaboration, the HSTF directs the full might of U.S. law enforcement towards identifying, investigating, and prosecuting the full spectrum of crimes committed by these organizations, which have long fueled violence and instability within our borders. In performing this work, the HSTF places special emphasis on investigating and prosecuting those engaged in child trafficking or other crimes involving children. The HSTF further utilizes all available tools to prosecute and remove the most violent criminal aliens from the United States. HSTF comprises agents and officers from Drug Enforcement Administration, the Wilkes-Barre City Police Department, the Wilkes-Barre Township Police Department, the Pennsylvania State Police, the Luzerne County Drug Task Force, and the Luzerne County District Attorney’s Office with the prosecution being led by the United States Attorney’s Office for the Middle District of Pennsylvania.

In this case, the maximum penalty is life imprisonment.  A sentence following the finding of guilt is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.

ICE Arrests Illegal Alien with a New York-Issued Commercial Driver’s License

This illegal alien was RELEASED into the country by the Biden Administration and had an outstanding warrant for wire fraud

The United States Department of Homeland Security (DHS) released the following statement after U.S. Immigration and Customs Enforcement (ICE) arrested an illegal alien who had been issued a commercial driver’s license (CDL) by the state of New York.

On September 4, an ICE officer with Enforcement and Removal Operations (ERO) Philadelphia was conducting inspections of commercial vehicles at a weigh station in Newberry, Pennsylvania. When one driver presented his CDL for inspection as required, the officer determined that the driver, Simranpal Singh, was an illegal alien from India and took the suspect into custody.

Simranpal Singh

At the time of his arrest, Singh had an outstanding warrant for wire fraud and wire fraud conspiracy out of the Middle District of Pennsylvania. He will remain in ICE custody pending transfer to the U.S. Marshals Service. Upon completion of the criminal case, ICE will resume custody and he will be given due process through pending removal proceedings.

“This illegal alien not only had a CDL from the sanctuary state of New York, but he also had an outstanding warrant for wire fraud,” said DHS Secretary Markwayne Mullin. “This is the result of the disastrous open-border policies of the Biden Administration and the sanctuary policies of Kathy Hochul’s New York. Thankfully, the brave men and women of ICE have taken this criminal off our roads, saving American lives. Sanctuary politicians must stop these reckless policies that put American lives in danger. DHS will never apologize for removing illegal aliens from our roadways and making America safe again.”

Singh illegally entered the United States through Arizona in June 2022 and was arrested by the U.S. Border Patrol. He was then RELEASED into the country by the Biden Administration.

Under Governor Kathy Hochul, New York’s sanctuary policies have had disastrous consequences in other states. These include:

  • In March, ICE arrested Sukhdev Singh, an illegal alien from India, after he caused a crash while driving a semi-truck that left a U.S. citizen hospitalized in critical condition in Indianapolis, Indiana. Singh had been given a Commercial Driver’s License (CDL) by Hochul’s New York.
  • In October 2025, ICE arrested Anmol Anmol, an illegal alien from India, in Oklahoma. Hochul’s New York had given Anmol a CDL that listed him as “No Name Given” Anmol.
  •  In August 2023, New York Police Department (NYPD) officers arrested Jose Antonio Ibarra, an illegal alien from Venezuela and Tren de Aragua gang member, for recklessly driving a motorcycle with a 2-year-old child who was not wearing a helmet. He was released due to New York’s sanctuary policies, and six months later, Ibarra went on to murder nursing student Laken Riley in Georgia in February 2024.
