MAYOR ADAMS’ STATEMENT ON PRESIDENT BIDEN’S STATE OF THE UNION

 

Tonight, President Biden laid out his vision about how to build a better America — one with a stronger economy, one that has safer streets with fewer guns, one that invests in our health care system and moves towards normal routines again while keeping up the fight against COVID-19, and one that defends democracy, both at home and abroad.

 

“While everything the president spoke about is worthy to note, I am deeply grateful that President Biden directly mentioned two heroes who sacrificed their lives for the people of New York City — Detectives Jason Rivera and Wilbert Mora. These two men died in the line of duty, and we must honor them by being clear that we will not abandon our streets, just as the president said.

 

“Public safety and justice are prerequisites to prosperity, so we must end the wave of gun violence we are seeing across New York and the rest of the nation.  

 

“The president came to New York City last month to discuss how the federal government can help cities combat the scourge of gun violence, which is exactly what my Blueprint to End Gun Violence does. Public safety is my administration’s highest priority, which is why we will remove guns from our streets, protect our communities, and create a safe, prosperous, and just city for all New Yorkers.”


CEO Of Payment Protection Program Lender MBE Capital Arrested In Connection With Fraudulent Loan And Lender Applications

 

Through Misrepresentations, RAFAEL MARTINEZ’s Company MBE Capital Fraudulently Obtained Approval to Issue PPP Loans as a Non-Bank Lender, Thereby Earning Over $70 Million in Lender Fees

 Damian Williams, the United States Attorney for the Southern District of New York, Thomas Fattorusso, Special Agent-in-Charge of the New York Field Office of the Internal Revenue Service, Criminal Investigation (“IRS-CI”), Amaleka McCall-Brathwaite, Special Agent-in-Charge, U.S. Small Business Administration, Office of Inspector General, Eastern Region (“SBA-OIG”), and Stephen Donnelly, Acting Special Agent-in-Charge, Office of Inspector General for the Board of Governors of the Federal Reserve System and the Bureau of Consumer Financial Protection, Eastern Region (“FRB-OIG”), announced today that RAFAEL MARTINEZ was arrested on multiple fraud charges and aggravated identity theft in connection with loan and lender applications submitted through the Paycheck Protection Program (the “PPP”) administered by the U.S. Small Business Administration (the “SBA”). 

MARTINEZ used false representations and documents to fraudulently obtain the approval of the SBA for his company, MBE Capital Partners, LLC (“MBE”), to be a non-bank lender through the PPP.  MARTINEZ then used that approval to obtain approximately $932 million in capital to issue PPP loans and earn over approximately $71 million in lender fees.  In addition, MARTINEZ engaged in a scheme to obtain a PPP loan for MBE in the amount of approximately $283,764 through false statements regarding the number of employees of MBE and the wages paid to MBE employees and using the forged signature of MBE’s tax preparer.  MARTINEZ was arrested yesterday and will be presented today in Manhattan federal court before U.S. Magistrate Judge Katharine H. Parker.

U.S. Attorney Damian Williams said:  “As alleged, Rafael Martinez faked his way into building his company MBE Capital Partners into an almost $1 billion PPP lender.  Not only did Martinez allegedly lie to a financial institution to obtain almost $300,000 in PPP loan funding for MBE Capital, he then submitted fraudulent financial statements to get the SBA to approve MBE Capital and to obtain over $800 million to issue PPP loans.  In doing so, Martinez and his company earned over $70 million in lender fees from the SBA, which among other luxury items, he audaciously spent on a villa in the Dominican Republic, a Ferrari, and private jets.  Thanks to the incredible work of our law enforcement partners, our Office will continue to prosecute those who committed fraud through the PPP and other pandemic relief programs.”  

IRS-CI Special Agent-in-Charge Thomas Fattorusso said: “American businesses and their employees have been struggling due to an unprecedented global pandemic, and the Paycheck Protection Program was created to serve as a safety net. Martinez is alleged to have fraudulently obtained funds through this program as both a recipient and a lender, and in effect, stole funds from his fellow Americans so he could purchase a New Jersey mansion, a villa abroad, and several luxury vehicles.”

SBA-OIG Special Agent-in-Charge Amaleka McCall-Brathwaite said:  “OIG stands firm against fraudsters determined to steal SBA program funds meant to uplift and support the nation’s small businesses during the pandemic. OIG remains committed to rooting out bad actors and protecting the integrity of SBA programs. I want to thank the U.S. Attorney’s Office and our law enforcement partners for their dedication and pursuit of justice.”

FRB-OIG Acting Special Agent-in-Charge Stephen Donnelly said:  “We are fully committed to bringing to justice wrongdoers who exploit and defraud financial institutions and the government’s response to the COVID-19 pandemic.”

According to the Complaint unsealed in Manhattan federal court:[1]

At all relevant times, MARTINEZ has been the CEO and primary owner of MBE, a New York limited liability company formed in or about March 2015.  Republic Group, LLC, a/k/a Republic Group Parts, LLC (“Republic Group”), which is owned and controlled by MARTINEZ, serves as the holding company for MBE and conducts business as MBE.  According to MBE’s website, “For over 20 years, MBE Capital Partners has been a leading provider of financing solutions for small and diverse businesses . . . .  In 2019, we financed over $1.7 billion in public and private debt and we funded over 35,000 PPP loans worth $800M.” 

On or about April 5, 2020, MARTINEZ applied to a financial institution for a government-guaranteed loan for Republic Group, d/b/a MBE through the SBA’s PPP.  In connection with the loan application, MARTINEZ represented that MBE had as many as 15 employees and an average monthly payroll of approximately $119,390 in 2019.  In fact, however, from in or about April 2018 through in or about April 2020, MBE had at most four employees who had a total average monthly payroll of no more $25,000.  In order to support the false representations made by MARTINEZ in the loan application about the number of employees at and the wages paid by MBE, MARTINEZ submitted fraudulent and doctored tax records that contained the forged signature of a tax preparer located in Manhattan, New York (the “Tax Preparer”).  Based on the false documentation provided by MARTINEZ, MBE was approved for a PPP loan in the amount of approximately $283,764, which was disbursed to a bank account controlled by MARTINEZ.  A majority of the loan proceeds do not appear to have been used for payroll for employees of MBE or other business expenses.

On or about April 9, 2020, within five days of applying for the PPP loan referenced above, MARTINEZ submitted an application to the SBA for MBE to become a non-bank PPP lender.  As part of the PPP lender application process, MARTINEZ represented that MBE had originated and serviced over $3.8 billion in business loans or other commercial financial receivables for the three-year period from in or about 2017 through in or about 2019 and submitted fraudulent financial statements that purported to be audited by the Tax Preparer’s firm for the years 2018 and 2019.  Based on the false information provided by MARTINEZ to the SBA, MBE was approved as a non-bank lender for PPP loans.

On or about April 27, 2020, MARTINEZ submitted various documents, including the same fraudulent audited financial statements for 2019 provided to the SBA, to a life insurance company (the “Company”) as part of a proposed partnership to fund PPP loans for minority and women-owned small businesses.  On or about May 13, 2020, the Company provided MBE with $100 million to fund PPP loans, which MBE in turn used as collateral to borrow additional capital of approximately $832 million through the Payment Protection Program Liquidity Facility (“PPPLF”) with the Federal Reserve.

As a result of the above fraudulent misrepresentations, MARTINEZ, through his company MBE, became an approved PPP lender and issued approximately $823 million in PPP loans to approximately 36,600 businesses.  These loans earned MARTINEZ a total of approximately $71.3 million in fees.  MARTINEZ spent the proceeds from his criminal conduct on, among other things, the purchase of a villa in the Dominican Republic for over $10 million, a $3.5 mansion located in Franklin Lakes, New Jersey, a chartered jet service, and several luxury vehicles, including a 2018 Porsche 911 Turbo, a 2017 Ferrari 488 Spider, a 2017 Bentley Continental GT, a BMW 750, and a 1962 Mercedes Benz 190. 

MARTINEZ, 56, of Franklin Lakes, New Jersey, was charged with one count of bank fraud, two counts of wire fraud, and one count of making false statements to a bank, each of which carries a maximum sentence of 30 years in prison; one count of making false statements, which carries a maximum sentence of two years in prison; one count of making false statements to the SBA, which carries a maximum sentence of two years in prison; and one count of aggravated identity theft, which carries a mandatory minimum sentence of two years in prison, which must be served consecutively to any other sentence imposed.  The maximum potential sentences are prescribed by Congress and are provided here for informational purposes only, as any sentencing of the defendant will be determined by the judge.

Mr. Williams praised the outstanding investigative work of IRS-CI, SBA-OIG, and FRB-OIG.  Mr. Williams also thanked Homeland Security Investigations and U.S. Customs and Border Protection for their assistance in the investigation.

 Governor Kathy Hochul today updated New Yorkers on the state's progress combating COVID-19.  

"We have made tremendous progress in our fight against COVID-19," Governor Hochul said. "We should continue to do the right thing and take the necessary precautions to keep our community safe and healthy. Vaccines are safe, effective, and the best way to prevent serious illness from COVID-19. If you haven't yet, get vaccinated as soon as you can. Encourage your family members, friends, and especially your children to get the vaccine as well."

SUMMER YOUTH EMPLOYMENT PROGRAM APPLICATIONS OPEN FOR NEW YORKERS AGED 14-24

 

Unprecedented $236 Million Baselined Investment Means 100,000 Summer Jobs for City Youth, Including Record 90,000 Under SYEP

New York City Mayor Eric Adams today opened applications for the New York City Department of Youth and Community Development’s (DYCD) Summer Youth Employment Program (SYEP), the nation’s largest summer youth employment initiative. In addition to a record 90,000 SYEP opportunities, 10,000 summer jobs will be available through other city agencies as the result of a $79 million investment in the Fiscal Year 2023 Preliminary Budget that Mayor Adams announced last month, bringing the total baselined funding to $236 million.

 

“Providing programs like SYEP for young New Yorkers keeps them safe and helps them secure a better future,” said Mayor Adams. “We are thrilled to open up applications for tens of thousands of youth to engage in summer jobs, develop skills and carry memories that will last a lifetime.”

 

“This summer represents the city of New York’s largest investment ever in youth employment experiences for our young people,” said Deputy Mayor for Strategic Initiatives Sheena Wright. “SYEP remains the cornerstone of this expansive effort and this year’s program will provide New York City youth with a variety of opportunities to explore careers, develop workplace skills, and secure a well-earned paycheck.”

 

“The Summer Youth Employment Program does more than connect young people to paid experiences — it provides them with invaluable career, civic, and leadership skills you don’t always find on a resume,” said DYCD Deputy Commissioner for Workforce Connect Valerie Mulligan. “DYCD and our network of SYEP providers, employers, and agency partners are thrilled to provide young people with a record number of opportunities this summer.”

 

SYEP provides young people with paid opportunities to explore potential career interests and pathways, allowing participants to engage in learning experiences that help develop their professional, social, civic, and leadership skills. Research shows summer jobs save lives, cut crime, and strengthen communities. The administration’s commitment to summer jobs for any young person who wants one is part of the Blueprint to End Gun Violence and an overall strategy to keep youth engaged and safe over the summer months.    

 

Programming is available through various service options:  

  • New York City teens aged 14 and 15 learn about career opportunities and make a difference in their communities through paid project-based activities.  
  • Young people aged 16 to 24 improve their work readiness skills and explore career pathways through paid summer jobs in a variety of industries throughout New York City.  
  • Special initiatives are available for:
    • Youth residing in select New York City Housing Authority (NYCHA) developments,
    • Students from select Department of Education (DOE) schools,
    • DOE ACCESS and Alternative School students,
    • Students in the Young Adult Borough Centers (YABC) program,
    • Unhoused or runaway youth,
    • Young people experiencing gender-based violence,
    • Youth in the Living for the Young Family Through Education (LYFE) Parental Program Support program, and
    • Youth who are in foster care, or justice- or court-involved care receiving preventive services through the New York City Administration for Children’s Services (ACS) or receiving cash assistance through the New York City Human Resources Administration (HRA). 

 

The 2022 program will include two six-week cohorts beginning July 5 and running through August 20. Applications can be completed online or at a participating community-based organization during the application period, which runs through Friday, April 22, 2022.     CARE, an international humanitarian organization that has set up an emergency Ukrainian Crisis Fund with the goal of providing immediate support for 4 million people. Donations will go toward providing Ukrainians with water, food, supplies, hygiene kits, immediate support and aid, and cash.

    Razom for Ukraine, a Ukrainian-American nonprofit working to not only support emergency response to the war, but also to provide a whole host of resources for people looking to help, including a round-up of rallies and events for people interested in showing their support for the #StandWithUkraine movement.

    Nova Ukraine, a 501(c)3 registered non-profit organization dedicated to providing humanitarian aid to Ukraine and raising awareness about Ukraine in the US and throughout the world.

    The Ukrainian Congress Committee of America (UCCA), which has launched a nationwide fundraising campaign to provide vital humanitarian aid to this population, as well as to the front-line defenders. Together with partners, they have secured warehouses in several regions where humanitarian aid supplies can be securely stored.

  2. Contact your members of Congress and ask them to support raising the refugee cap. Alexandria and other officials are calling on the U.S. to raise our refugee cap to allow Ukrainians, along with other victims of war such as Afghans, to resettle in the U.S. We should do our part to accept families, not turn them away.

  3. Support anti-war demonstrations and your local Ukrainian community organizations. The people’s will matters and we are seeing that anti-war demonstrations in Russia and beyond are making a political impact. Do not think your presence and voice don’t matter. They do.

  4. Only share verified information. In rapidly developing situations such as these, misinformation and propaganda can spread easily even by those with good intentions. If you are going to share something, ask yourself if it’s a verified, trustworthy source. 

Lastly, if you have a prayer, meditation, or contemplation practice, it can be helpful to focus the mind and allow us to keep putting one foot in front of the other for the day ahead. 

Together we will continue to condemn any and all violence and stand in solidarity with all communities who are facing the threats of violence and war.

City to Host Virtual Town Hall for Tenants on Housing Policy Changes

 

City officials will host a Know Your Rights Town Hall for Tenants to discuss recent housing policy changes including the expiration of the NYS eviction moratorium and the re-opening of the Emergency Rental Assistance Program (ERAP).

Leaders will also discuss tenant rights and resources such as how to access free legal services, apply for rental assistance and benefits, and obtain support to address conditions, harassment, and illegal evictions.

Attorney General James Returns Over $1 Million to New Yorkers for Events Canceled Due to Pandemic Shutdowns

 

Thousands of New Yorkers to Receive Refunds from Westchester Broadway Theater

 New York Attorney General Letitia James today announced that her office has recovered more than $1 million for thousands of customers who bought tickets to Westchester Broadway Theater (WBT), but were denied refunds when performances were canceled due to pandemic-related closures. The WBT, a live theater company formerly located in Elmsford, has agreed to refund tickets and gift certificates purchased prior to the start of the pandemic in March 2020. Customers have already begun receiving their refund checks.

“After the Westchester Broadway Theater took its final bow, thousands of theatergoers were unable to get refunds for tickets they had already purchased,” said Attorney General James. “For months, theatergoers were stuck in the wings, but today, my office helped put more than $1 million back into New Yorkers’ pockets. While the curtains are finally closed on this saga, we will continue to go after companies that refuse to reimburse consumers.”

The WBT provides dinner and live theater performances of popular musicals and concerts on an open stage. As of March 2020, the theater had sold more than 30,000 tickets to upcoming performances which were canceled when WBT was forced to close because of the COVID-19 pandemic. Following the shutdown, the Office of the Attorney General (OAG) received numerous complaints from ticketholders that WBT refused to issue refunds for canceled shows. In October 2020, OAG opened an investigation into WBT after it was reported that the theater was permanently closing and would not reimburse patrons. Instead, WBT created a ticket exchange policy with the White Plains Performing Arts Center (WPPAC), whereby WPPAC would honor tickets and gift cards bought for WBT shows. However, no refund option was offered to WBT ticketholders, and the ticket exchange did not honor the value of the dinner portion of WBT tickets. Only 930 WBT ticket holders participated in the ticket exchange.

WBT has agreed to refund a total of $1,127,258.84 to thousands of customers, even the ones who participated in the ticket exchange with WPPAC. Gift certificate holders who show a receipt may also be eligible for a refund or may use the gift card at WBT’s new location in Chappaqua.

Today’s agreement is the latest in Attorney General James’ ongoing efforts to refund New York consumers for events canceled in the wake of the pandemic. Last year, OAG returned $427,000 to New Yorkers who paid deposits for events at Greentree Country Club in New Rochelle, but had their events canceled. To date, Attorney General James has recovered millions of dollars for New Yorkers in refunds for pandemic-related shutdowns.

If consumers are having issues receiving a refund on a deposit for an event cancelled due to COVID-19 statewide regulations, they are encouraged to fill out an OAG complaint form or call the office’s hotline at (800) 771-7755.

MAYOR ADAMS’ STATEMENT ON VOTE BY POLICE PENSION FUND TO DIVEST FROM RUSSIAN ASSETS

 

 “Freedom cannot be denied, here or anywhere. That’s why I stand in support of efforts to divest the city’s pension funds from Russian assets in light of the ongoing invasion of Ukraine — an unprovoked and unjustified war. This is not about penalizing the Russian people, but about holding President Putin and his government accountable for violating a nation’s sovereignty and inflicting widespread suffering on its people. Our administration is committed to standing with Ukrainians and refugees here and abroad while doing all we can to advance peace, in collaboration with the community and our federal partners.”
