 IMPORTANT NOTE: Due to the holiday, HERDS data collection from health care facilities will be paused from Saturday, July 2 through Monday, July 4. Data from Friday, July 1 will be reported on Tuesday, July 5. Further, four days of cumulative data—from July 2 to July 5—will be reported on Wednesday, June 6. As a result, some data may appear higher than recent trends. 

NOTE: Updates to the CDC's cumulative death data files have been paused since June 6, 2022, as the CDC upgrades its system. As of June 28, 2022, CDC reporting has not yet resumed. Any questions about this should be directed to the CDC. During this time, total deaths and new daily deaths reported through HERDS will continue as normal.   

Governor Kathy Hochul today updated New Yorkers on the state's progress combating COVID-19. 

"As New Yorkers travel to spend Fourth of July weekend with family and friends, I encourage everyone to continue to exercise caution and lean on the tools we know that protect us from COVID-19," Governor Hochul said. "Getting vaccinated, staying up-to-date on your boosters, and testing if you're experiencing symptoms, are our best defenses. If you do end up testing positive, talk to your doctor about available treatments."

The Health Electronic Response Data System is a NYS DOH data source that collects confirmed daily death data as reported by hospitals, nursing homes and adult care facilities only.     

Important Note: Effective Monday, April 4, the federal Department of Health and Human Services (HHS) is no longer requiring testing facilities that use COVID-19 rapid antigen tests to report negative results. As a result, New York State's percent positive metric will be computed using only lab-reported PCR results. Positive antigen tests will still be reported to New York State and reporting of new daily cases and cases per 100k will continue to include both PCR and antigen tests. Due to this change and other factors, including changes in testing practices, the most reliable metric to measure virus impact on a community is the case per 100,000 data -- not percent positivity.

Attorney General’s Office of Special Investigation Opens Investigation Into Civilian Death in Franklin County

 

The New York Attorney General’s Office of Special Investigation (OSI) has opened an investigation into the death of Joshua De’Miguel Kavota, who died on June 29, 2022, following an encounter with members of the Saranac Lake Police Department.

On the morning of June 29, 2022, two members of the Saranac Lake Police Department responded to a report of an alleged stabbing by Mr. Kavota. The officers found Mr. Kavota outside a shop on Bloomingdale Avenue and asked him if he had a knife. Mr. Kavota allegedly came at one of the officers with a knife, and the other officer shot Mr. Kavota. Mr. Kavota was taken to a local hospital where he was later pronounced dead. Officers recovered a knife at the scene.

Pursuant to New York State Executive Law Section 70-b, OSI assesses every incident reported to it where a police officer or a peace officer, including a corrections officer, may have caused the death of a person, by an act or omission. Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed. Also, the decedent may or may not be in custody or incarcerated. If OSI’s assessment indicates an officer caused the death, OSI proceeds to conduct a full investigation of the incident.

4th of July Weekend Typically Sees a Rise in Firework Related Injuries and Increase in Drunk Driving Cases 

Secretary of State Robert J. Rodriguez Urges New Yorkers to Celebrate Safely and Use Extreme Caution with Fireworks and Family Gatherings  

The New York State Division of Consumer Protection (DCP) reminds New Yorkers to keep safe while celebrating Independence Day. As we celebrate this annual tradition with festivities ranging from fireworks, picnics, parades, family gatherings and barbecues, let’s also remember basic safety tips that apply to everyone.

“I know many New Yorkers are eager to celebrate Independence Day this year, but we must ensure our celebrations are safe and fun,” said New York State, Secretary of State Robert J. Rodriguez who oversees the NYS Division of Consumer Protection. “Around this holiday, the biggest threats to safety are very close to home. The 4th of July is one of the holidays with the highest number of accidents. We want to make sure the time-honored holiday tradition of fireworks is done safely by following basic tips.”

“Summertime, and especially the Fourth of July, are times of celebration and togetherness, but when fireworks and sparkling devices are added to the party, it can lead to very serious injuries for those involved,” New York State Homeland Security and Emergency Services Commissioner Jackie Bray said. "The best way to stay safe this Fourth of July is to leave the fireworks to the professionals, but if you plan on using sparkling devices, please make sure you do so as safely as possible.”

Around the 4th of July, there are a lot of fire-related accidents. Every year, thousands of people — most of them children, teens and young adults — are injured while using fireworks. Most of these injuries happen in the month around the 4th of July. The Consumer Product Safety Commission found that nationally nearly half of the fireworks-related injuries were to people younger than 20 years of age.

Additionally, the 4th of July is one of the most dangerous holidays to be on the road. According to the National Traffic Safety Administration, dates around this holiday, sadly, often see an increase in impaired driving crashes. Drunk driving isn’t the only risky behavior causing crashes on our roads; drug-impaired and distracted driving are issues too. Many people recognize that driving under the influence is dangerous.  However, many people fail to recognize the danger of driving while distracted, especially if they try to talk or text on a cell phone. 

NYS Division of Consumer Protection wants you to enjoy a safe holiday and offers these tips you can follow:

FIREWORKS - WHAT’S LEGAL AND WHAT’S NOT IN NEW YORK STATE:

What’s Legal:                                                  

  • Sale of sparkling devices by registered sellers from June 1 until July 5 annually. Sparkling devices are ground-based or handheld sparking devices that produce a shower of colored sparks or colored flame, crackling or whistling noise and smoke. They do not launch into the air.
  • Users must be 18 years or older to use sparkling devices.

What’s Not Legal:

  • Sparkling devices are illegal in New York City and the following counties: Albany, Bronx, Columbia, Kings, Nassau, New York, Orange (prohibited in the Cities of Middletown and Newburgh only), Queens, Richmond, Schenectady, Suffolk, Warren and Westchester. The list of counties that prohibit the sale and possession of sparkling devices is ever changing, thus to be sure your compliant please check with your local county sheriff’s office.
  • Any other types of fireworks including firecrackers, bottle rockets, roman candles, spinners, and aerial devices are illegal statewide. 

TIPS TO CELEBRATE SAFELY:

Tips for Using Sparkling Devices Safely:

  • Children and Sparklers are a Dangerous Combination. Never allow young children to play with or ignite fireworks, including sparklers. Sparklers burn at temperatures of about 2,000 degrees Fahrenheit. This is hot enough to melt some metals.
  • Never throw or point fireworks toward people, animals, vehicles, structures or flammable materials. Always follow the instructions on the packaging.
  • Keep a supply of water close by as a precaution.
  • Make sure the person lighting fireworks always wears eye protection.
  • Light only one firework at a time and never attempt to relight "a dud."
  • Store fireworks in a cool, dry place away from children and pets.
  • If you are impaired by alcohol, don’t use fireworks.

Tips for Driving Safely:

  • Avoid driving while impaired. If you are driving this July 4th, make sure to watch out for others as they may not be sober.
  • If you plan to drink, make a plan ahead of time for a sober ride home.
  • A sober driver is one who does not drink at all, not the one who has had the least to drink from a group of people. Even if you’ve had only one drink, let someone who hasn’t been drinking take you home.
  • If you’re hosting a 4th of July gathering, help the designated drivers out by making sure there are plenty of non-alcoholic beverages.

Senator Luis Sepulveda - What happened in Albany today?

 

NYS Senator Luis Sepúlveda and the Senate Majority Take Action to Address SCOTUS Rulings Invalidating New York’s Concealed Carry Law and Overturning Roe v. Wade

 Today, I joined my colleagues in the NYS Senate Majority to take assertive action to protect New Yorkers by passing legislation that enhances licensing requirements for concealed carry permit applicants, adds new provisions for sensitive areas where the permit holder is prohibited from carrying a concealed firearm, enhances safe storage requirements to apply if a minor under the age of 18 lives in the home, makes technical changes to the Body Armor Law, and establishes New York as a “point of contact” state. The NYS Senate Majority also celebrated the first passage of an amendment to codify the right to an abortion and the right to contraception in the State Constitution. This amendment would also update the existing Equal Rights Amendment to extend current protections to several new classes, including on the basis of sex, disability, national origin, ethnicity, and age.  

NYS Senator Sepúlveda said: “I am proud to be a member of a conference that acts swiftly to uphold the rights of New Yorkers. It was critical we moved rapidly to protect New Yorkers and keep more guns off of our streets. The statute passed today is not only consistent with the allowable restrictions outlined in New York Rifle & Pistol Assoc., Inc. v. Bruen, but it also ensures that New Yorkers are protected from gun violence by enumerating a list of sensitive locations where even people with licenses cannot carry a firearm including our subways. Additionally, after last week’s reversal of Roe v. Wade, we also made it clear that New York State must continue to stand up and be a national leader to protect women and individual rights. We cannot allow women to become second class citizens by a Supreme Court decree. That is why we are proactively codifying broader equal rights under the law and ensuring the constitutional right to abortion and contraception in New York. This is a massive step forward for New York. While other states move backwards, and seek to live in the past, we are taking an affirmative stance against the Supreme Court’s attack on our rights.  I look forward to passing this again next year so it can be placed before voters in November 2023. I am also incredibly proud of our Democratic leadership for advancing these historic changes and thank Majority Leader Andrea Stewart-Cousins, Speaker Heastie, and Governor Hochul for their partnership in getting this done.”  

The legislation advanced by the Senate Majority on guns, includes:

Concealed-Carry Permitting Process

●       Adds a definition of “good moral character”:

      ○       Good moral character as defined in this legislation means having the essential character, temperament, and judgment necessary to be entrusted with a weapon and to use it in a manner that does not endanger oneself or others.

     ○       Defining “good moral character” more specifically in this way will make sure that licensing officers will create processes that assess an individual’s trustworthiness to handle a firearm.

●       This proposal would require concealed-carry applicants to meet in person with a licensing officer for an in-person interview. Under this legislation, it would be required for an applicant to submit the following information:

     ○       Names and contact information for the applicant’s current spouse or domestic partner, and current cohabitants, and an indication if any minors live with the applicant; 

     ○       Names and contact information of at least four character references; 

     ○       Certification that the applicant has completed all of the required training;

     ○       A list of social media accounts from the past three years to confirm that applicant’s  character and conduct; and 

     ○       Anything else the licensing officer requests that is reasonably required to complete their  review and assess good moral character. 

●       Furthermore, in addition to the disqualifying felonies in current law, concealed-carry applicants must also not have been convicted of assault in the third degree, misdemeanor driving while impaired, or menacing within the previous five years

Sensitive Places and Trespass

●       Criminal possession of a weapon in a prohibited area will be a Class E felony punishable by up to four years in prison. In addition, there will be a separate Class E felony for criminal possession of a weapon in private property where the owner has not explicitly authorized weapons on the premises.

●       Carrying a concealed weapon will be prohibited in the following areas:

     ○       Federal, state, or local government buildings, including courts;

     ○       Places providing health or medical care, such as hospitals, nursing homes, adult care facilities, domestic violence shelters, medical campuses, behavioral facilities, mental health and chemical dependency facilities, and clinics;

     ○       Places of worship or religious observation;

     ○       Places where children gather, including but not limited to, schools, libraries, daycare centers, playgrounds, parks, and zoos;

     ○       Any OCFS regulated locations that provide services to children youth or young adults

     ○       Any OPWDD, OASAS, OMH, and OTDA funded or regulated locations, including homeless shelters;

     ○       Places used for public transportation or transit including, airports, train stations, subway and rail stations, and bus terminals;

     ○       Establishments where alcohol or cannabis is consumed;

     ○       Locations when being used as a polling place;

     ○       Educational institutions including, colleges, universities, and private schools;

     ○       Theaters, stadiums, arenas, racetracks, museums, amusement parks, performance venues, concerts, exhibits, conference centers, banquet halls, casinos, and venues for athletic games or contests;

     ○       Any public sidewalk restricted from access for a permitted special event that has signage

     ○       Any gathering of individuals who are collectively expressing First Amendment rights of protest or assembly.

     ○       Times Square

●       The prohibition of carrying weapons in sensitive areas does not apply to police officers, peace officers, armed security guards, active duty military personnel, or any person who is lawfully engaged in hunting.

     ○       The bill also ensures residents of childcare facilities (such as foster parents) and other similar locations can keep a firearm in the home as long as it is stored safely and in accordance with all applicable regulations.

Safe Storage

●       Expands existing safe storage laws, which were originally enacted in 2019. Current law requires guns to be safely stored in the home if a person under the age of 16 lives in the home or if a person legally disqualified from possession of a gun lives in the home. This bill would raise the age limit, so that safe storage laws would apply if a minor under the age of 18 lives in the home.

●       Implements a vehicle safe storage requirement so that a person cannot leave a gun in a car outside of his or her immediate possession or control, unless the gun is in a lockbox.

Body Armor

●       The legislation amends the definition of body vest to “armor,” which means any product that is a personal protective body covering intended to protect against gunfire, regardless of whether the product is to be worn alone or is sold as a complement to another product or garment. The terms ‘vest’ and ‘armor’ have been used interchangeably in casual parlance, but they do not mean the same thing. This legislation amends this definition so as to avoid misinterpretation.

●       The legislation also prohibits the unlawful sale and purchase of body armor if the individual or entity does not engage in an ‘eligible profession’ which includes police officers, peace officers, those employed in military services and other similar professions.


Point of Contact

●       Establish New York as a “point of contact” state by requiring gun dealers to contact the State Police to conduct the background check that must be done before an individual can purchase a gun. In 2017 alone, NCIS stopped 181,000 prohibited people from attempting to buy guns, so implementing this bill would decrease the number of those who are unfit from purchasing a gun in New York.

Ammunition Database

●       Makes technical changes to the existing law that establishes an ammunition database to verify ammunition sales in New York, enacted as part of the SAFE Act in 2013, and strikes the memorandum of understanding between the previous Executive and Republican Majority Leader stalling its implementation.

●       Any seller of ammunition or dealer of firearms shall keep either an electronic record, or dataset, or an organized collection of structured information, or data, typically store electronically in a computer system approved as to form by the Superintendent of the State Police.

     ○       In the record shall be entered at the time of every transaction involving ammunition the date, name, age, occupation and residence of any person from whom ammunition is receiving or to whom ammunition is delivered, and the amount, caliber, manufacturer’s name and serial number, or if non, any other distinguishing number of identification mark on such ammunition.

Expanding Protected Classes Under the Equal Rights Amendment: 

●      Ethnicity,  national  origin, age, disability and sex. Sex includes sexual  orientation,  gender  identity, gender expression,  pregnancy,  pregnancy outcomes, reproductive healthcare and autonomy. 

●      With these enumerations, this amendment guarantees a constitutional right to reproductive healthcare for any individual in the state of New York. It also protects marriage equality and other rights that the Supreme Court has endangered.

●      Additionally, this amendment preserves laws designed to prevent or dismantle discrimination on the basis of these characteristics such as affirmative action.

New Yorkers Advised to Swim Only Where Lifeguards Are Present, Take Advantage of Cooling Options Citywide, Watch July 4th Fireworks Safely


  New York City Mayor Eric Adams today announced new measures and shared resources to help New Yorkers enjoy a safe July 4th holiday weekend by preventing crime and gun violence, cracking down on impaired driving, and offering other health and safety guidance. As part of the city’s efforts, the New York City Police Department (NYPD) will have officers on the ground throughout the five boroughs to prevent crime with a particular focus on gun violence. The NYPD will also focus traffic enforcement on impaired driving, while the New York City Department of Transportation (DOT) and the New York City Taxi and Limousine Commission (TLC) will disseminate messaging and offer alternative transportation options to prevent impaired and reckless driving. The New York City Department of Parks and Recreation is reminding all New Yorkers and visitors to swim on beaches only when and where lifeguards are present, and the Cool It! NYC map highlights locations for New Yorkers to cool down across the city. The New York City Department of Buildings (DOB) is providing guidance for watching the July 4th fireworks safely, without creating risk of a dangerous fall from a rooftop, terrace, balcony, or fire escape.

 

“We are going to use every tool in our toolbox to provide New Yorkers a safe and enjoyable July 4th holiday weekend,” said Mayor Adams. “I want to say to all New Yorkers and those visiting our city: Use these resources, stay safe, and have a great time. Happy July 4th, New York City.”

 

Crime and Gun Violence: NYPD uniformed officers will be working around the clock, in every borough to keep New Yorkers safe. The Patrol Services Bureau is assigning uniformed borough executives to the field overseeing rank-and-file officers on foot posts in targeted areas to increase police presence to deter crime and violence. Additionally, elements of the NYPD’s Summer Violence Strategy will be in place to ensure robust coverage particularly in the areas of the city experiencing upticks in violent crime. Since the Summer Violence Strategy rolled out on May 1, shootings are down 19 percent as compared to a year ago. As in past years, NYPD’s fireworks suppression efforts are underway with teams of officers who work simultaneously to prevent or address gun violence. In addition to visible officers as part of the NYPD’s plans for a safe July 4th holiday, the department’s assets in the air, on the water, and in the subway system are being mobilized in directed maneuvers. There will also be unseen elements, with a network of cameras feeding back real-time images to the Joint Operation Center acting as a force multiplier for the officers on the ground.

 

Safe Driving: NYPD will be extra vigilant in removing impaired drivers from our streets. Stepped-up enforcement will begin Friday and continue through the early morning hours of Tuesday. Officers will be deployed on highways and on local streets with an increased focus on impaired drivers, including drunk and drugged driving. Simultaneously, DOT will continue its anti-impaired driving messaging on social media channels, targeting peak times and holiday weekends to maximize awareness. TLC-licensed taxis and for-hire vehicles are safe alternatives for anyone who is unable to drive themselves to their destination.

 

Beach and Pool AccessThe Parks Department is reminding New Yorkers about the importance of water safety along its 14 miles of beaches. No one should take the unnecessary risk of swimming in closed off areas or areas not staffed with a lifeguard. Instead, swim only when lifeguards are on duty. Closed beaches are red flagged – meaning there is no lifeguard in the area and swimming in that area is not allowed. Lifeguards are on duty at designated beaches daily from 10:00 AM to 6:00 PM. Parks’ 51 outdoor pools can be found across the five boroughs and are open seven days a week from 11:00 AM to 7:00 PM, with a break from 3:00 to 4:00 PM.

 

Staying Cool: For those staying close to home, the Parks Department has highlighted cooling elements citywide on its Cool It! NYC map. The map helps people find the closest outdoor pools, spray showers, and water fountains in their neighborhoods, as well as the leafiest blocks and parks with the most shade to help stay cool this summer.

 

Avoiding Dangerous Falls: DOB is reminding property owners and tenants of safety regulations regarding the use of rooftops, terraces, balconies, and fire escapes. These regulations apply all year and are particularly relevant this holiday weekend, as New Yorkers look for vantage points to view July 4th fireworks. Unauthorized use of building roofs and fire escapes have tragically led to fatal falls in recent years, and the risk of deadly falls is heightened when these spaces are overcrowded. New Yorkers should take safety precautions and not access building rooftops to watch the fireworks unless the rooftop has an approved deck or other approved space for gatherings. Do not gather to watch the fireworks on fire escapes, and do not lean out of a window or over a ledge or railing for a better view of the fireworks display.

 

“As America approaches another birthday, the city is committed to ensuring that residents celebrate safely. From the beaches to the city streets, our resources will be dedicated to preventing dangerous behavior,” said Deputy Mayor for Operations Meera Joshi. “I commend the mayor for using all of the tools at his disposal to keep New Yorkers safe and secure.”

 

“The Fourth of July weekend is a time to spend with family, friends, and neighbors,” said Deputy Mayor for Public Safety Phil Banks. “It is not a time for reckless or selfish behavior. Public safety is about the collective caring for community and one another. Drinking and driving, the use of illegal fireworks, excessive intoxication, aggressive driving, and violence are the type of actions that can turn a fun summer weekend bad for everyone. Safety is not accidental. It starts with awareness and self-control.”

 

“As New Yorkers celebrate this holiday weekend, we are reminding New Yorkers about safety, including reminding those driving to act responsibly,” said DOT Commissioner Ydanis Rodriguez. “We encourage those celebrating to take mass transit — but if you do get behind the wheel, there is no excuse for deadly driving that endangers yourself and others. We thank the mayor and members of the police force who are out keeping our streets safe.”

 

“New Yorkers are lucky to have a robust set of transportation alternatives — including over 150,000 professionally licensed TLC drivers — to ensure that there is never a reason to drive under the influence,” said TLC Commissioner David Do. “I urge New Yorkers to take advantage of these options, this weekend and always, to keep yourselves and your fellow New Yorkers safe from dangerous driving.”

 

“This holiday weekend, please celebrate safely: If you’re planning to go to the beach, remember to only swim where lifeguards are on duty,” said Parks Commissioner Sue Donoghue. “Lifeguards are there to protect you, so please follow their lead, and if a beach is red-flagged, do not enter the water.”

 

“We understand that New Yorkers have a special relationship with their rooftops, but the risk of a serious fall with life-changing consequences this holiday weekend is real. We want everyone to have a safe and happy Fourth of July — and to do that, New Yorkers need to make sure they select an appropriate place for their gatherings and to view the fireworks,” said DOB Commissioner Eric Ulrich. “Building owners and property managers should proactively reach out to their tenants and let them know that areas like unsecured rooftops and fire escapes are not safe places to enjoy the Fourth of July holiday.”

 

“As we head into the holiday weekend, the NYPD will step up enforcement to make sure all of our road users enjoy a safe Independence Day holiday,” said NYPD Chief of Transportation Kim Y. Royster. “Our highly trained highway patrol units will be laser-focused on impaired drivers. They will be working with our government partners to remove these drivers off our highways. Police officers will be extra vigilant in removing impaired drivers from our local streets.  This year, we are asking all New Yorkers to do their part and drive sober. Traffic safety is public safety.”

 

Operators Of Over $16 Million International Boiler Room Fraud Sentenced To Years In Prison

 

Damian Williams, the United States Attorney for the Southern District of New York, announced that CHRISTOPHER WRIGHT and STEVEN HOOPER were sentenced to 52 months in prison and 42 months in prison, respectively, for defrauding elderly victims in connection with the fraudulent sale of stock and fake carbon credits as part of an over $16 million international telemarketing scheme.  WRIGHT and HOOPER previously pled guilty before U.S. District Judge Jed S. Rakoff, who imposed the sentences. 

According to the allegations in the Indictment, court filings, and statements made in Court:

From in or about 2009 up to and including in or about 2015, WRIGHT, HOOPER, and other co-conspirators engaged in a scheme to defraud victims in the United Kingdom through the sale of false, fraudulent, and materially misleading investments, and to launder the proceeds of the fraud through bank accounts in the United States and foreign countries.  WRIGHT and HOOPER used the services of telemarketing call centers to identify and cold-call potential victims, who were primarily elderly or retired individuals residing in the United Kingdom.  Over a series of telephone calls, the telemarketers persuaded victims to invest money under various false and misleading pretenses, including the promise of short-term, high-yield, no-risk returns, when in fact the investments were high-risk, illiquid, and in some instances, entirely fictitious.  Many victims were persuaded to make additional investments under the false pretense that they would not be permitted to sell their holdings until they purchased more.  In reliance on the false representations and promises, the victims wired funds to various bank accounts in the United States, including in the Southern District of New York, in the names of corporate entities controlled by one of WRIGHT’s and HOOPER’s co-conspirators.  WRIGHT and HOOPER assisted in emailing of documents related to the fraudulent investments, including purchase contracts and investment certificates, to the victims.  Victims who tried to sell their investments found they were unable to do so.  The victims never received a refund on their principal or any return on their investments. 

In order to conceal the nature, location, source, ownership, and control of the proceeds of the fraudulent scheme, WRIGHT, HOOPER, and their co-conspirators set up overseas bank accounts, including in Cyprus, Switzerland, and the United Kingdom, in the names of various shell companies, which were used to launder a substantial portion of the fraud proceeds.

The nature of the particular fraudulent investment vehicles being marketed to the victims changed over time.  From in or about 2009 until in or about 2011, WRIGHT and his co-conspirators sold the stock of Florida-based corporation DirectView Holdings, Inc. (“DirectView”) to the victims based on telemarketers’ false representations and promises that the shares were a no-risk, short-term investment in a debt-free company, and that the shares were likely to increase over 100 percent in value in a short period of time.  In fact, DirectView’s annual report filed with the United States Securities and Exchange Commission (“SEC”) for the year ending December 31, 2010, contained dire warnings about the poor fiscal health of DirectView and the risk attendant in purchasing stock, including that the company “may be forced to cease operations” due to losses and cash flow problems, and purchasers “may find it extremely difficult or impossible to resell our shares.” 

From in or about 2011 until in or about 2015, WRIGHT, HOOPER, and their co-conspirators engaged in the sale of fraudulent “carbon credits.”  The boiler room callers appealed to victims by claiming that the investments would be environmentally friendly and help address the climate crisis.  “Carbon credits,” which are issued as part of governmental and voluntary regulatory regimes, are permits representing the right to emit a certain number of tons of carbon dioxide into the atmosphere. “Carbon offsets,” which are tied to particular carbon-dioxide emissions reducing projects, represent a reduction in carbon dioxide emissions, and can be purchased by individuals and companies to “offset” their or third parties’ “carbon-footprints.”  The victims were falsely promised that the carbon-related investments they purchased could be easily sold, carried no risk, and would yield a significant, short-term return.  In fact, the carbon credits and offsets that were sold to the victims were fake, and did not represent any actual carbon credits or offsets. 

In total, victims lost over $16 million.

In addition to their prison terms, WRIGHT, 49, and HOOPER, 49, who are both citizens of the United Kingdom, were ordered to pay restitution in the respective amounts of $16,407,459.52 and $14,457,104.19. WRIGHT and HOOPER were also ordered to pay forfeiture in the amount of $1,632,443.10 and $760,977.12, respectively.

Mr. Williams praised the outstanding investigative work of IRS Criminal Investigation in this case.

Governor Hochul Announces State Police and Local Law Enforcement to Crack Down on Drunk and Drugged Driving During Fourth of July Weekend

Troopers and Local Law Enforcement to Target Impaired and Reckless Drivers through the Holiday Weekend 


 Governor Kathy Hochul today announced that the New York State Police and local law enforcement agencies will increase patrols to crack down on drunk and drugged driving and other traffic infractions this Fourth of July.  State Troopers will conduct sobriety checkpoints and target reckless and aggressive driving statewide to keep New York highways safe during what is considered the biggest travel weekend of the summer. The campaign, which is funded by the Governor's Traffic Safety Committee, will begin at 6 p.m. on Friday, July 1, 2022, and run through 3 a.m. on Tuesday, July 5, 2022. 

"State Police and local law enforcement agencies will once again be out in force on New York's roadways this holiday weekend," Governor Hochul said. "We want New Yorkers to have fun celebrating the Fourth of July, but we also want them to do so responsibly. We have zero tolerance for drivers whose reckless actions endanger the lives of others and will hold those who do so accountable."  

New York State Police Superintendent Kevin P. Bruen said, "The Fourth of July is known for its fun and fireworks, but New Yorkers should also remember that making the wrong decision to drive while impaired can result in tragedy. If your celebrations include alcohol, plan for a safe ride home, and if you're travelling this weekend, remember to put down the phone, follow posted speed limits, and always put safety first."  

Last year, the State Police issued 10,238 traffic tickets during the Fourth of July weekend. Troopers arrested 195 people for DWI and investigated 648 crashes, including two fatalities. 

During this enforcement period, drivers can expect to encounter sobriety checkpoints and increased DWI patrols. Law enforcement will also be looking for motorists who are using their phones and other electronic devices while behind the wheel. Drivers should also remember to "move over" for stopped emergency and hazard vehicles stopped on the side of the road when they travel New York roadways. 

Troopers will be using both marked State Police vehicles and Concealed Identity Traffic Enforcement (CITE) vehicles as part of the operation. The CITE vehicles allow Troopers to more easily identify motorists who are using handheld devices while driving. These vehicles blend in with everyday traffic but are unmistakable as emergency vehicles once the emergency lighting is activated. 

DMV Commissioner and Chair of the Governor's Traffic Safety Committee Mark J.F. Schroeder said, "Independence Day is a wonderful day to celebrate with family and friends, especially when it is part of a long weekend. We want everyone to celebrate safely, so please have a plan if you will be drinking and do not drive impaired." 

The GTSC and the New York State STOP-DWI Foundation remind motorists that their "Have a Plan" mobile app, is available for Apple, Droid and Windows smartphones. The app enables New Yorkers to locate and call a taxi or rideshare service and program a designated driver list. It also provides information on DWI laws and penalties and provides a way to report a suspected impaired driver. 

If you drive drunk or drugged, you not only put your life and the lives of others at risk, but you could also face arrest, jail time, and substantial fines and attorney fees. The average drinking and driving arrest costs up to $10,000. Arrested drunk and drugged drivers face the loss of their driver's license, higher insurance rates, and dozens of unanticipated expenses from attorney fees, fines and court costs, car towing and repairs, and lost time at work. 

The New York State Police, GTSC and NHTSA recommend these simple tips to prevent impaired driving: 

  • Plan a safe way home before the fun begins. 
  • Before drinking, designate a sober driver. 
  • If you're impaired, use a taxi, call a sober friend or family member, or use public transportation. 
  • Use your community's sober ride program. 
  • If you suspect a driver is drunk or impaired on the road, don't hesitate to contact local law enforcement. 
  • If you know someone who is about to drive or ride while impaired, take their keys and help them make other arrangements to get to where they are going safely. 

PUBLIC ADVOCATE QUESTIONS CITY’S HOUSING ‘BLUEPRINT’ IN COUNCIL HEARING

 

New York City Public Advocate Jumaane D. Williams questioned administration officials today about the city’s new ‘blueprint’ for affordable housing, highlighting deficiencies and a lack of much-needed specificity within the framework. At the hearing of the City Council Committee on Housing and Buildings, the Public Advocate pushed for clarity and additional information which the administration has yet to provide his office or the people of New York.


“After reviewing “Housing our Neighbors: A Blueprint on Housing & Homelessness”, our office has concluded that the blueprint puts together in one place all that we already know, but does not include the specifics of what we need to know, and an analysis of why certain affordable housing programs are not delivering what we need, when we need it and not in the numbers that are needed in New York City,” said Public Advocate Williams in testimony. “My office is still awaiting a briefing of the blueprint. I am thankful the Council is holding this hearing and hope it will illuminate many unanswered questions.”


The Public Advocate released a report in December 2021, Reviewing the Mayor’s Housing Plan to Bolster Affordability and Equity, about previous failed efforts by the city to meet the affordable housing needs in either price or volume, and has long called for deeper affordability standards. On the blueprint’s guidelines for NYCHA, which the Public Advocate has repeatedly declared to be the worst landlord in the city, he said, “The report points out that NYCHA’s current work order system is backlogged with over 600,000 work orders. Moreover, there are wait times of over 300 days for work performed by workers in skilled trades such as painters, carpenters, electricians, and plumbers. The report goes on to say that the administration will implement 'Work Order Reform Today' that addresses duplicative or unnecessary work orders, and scheduling repairs around a resident’s availability. My question is– how?” 


The hearing comes amid a mounting eviction crisis as rents are rising and the state has failed to enact Good Cause eviction protections. Yesterday, an Albany judge struck down local good cause protections, further highlighting the need for immediate state action. 


In noting that the affordable housing and homelessness crises are truly one issue, he commended the blueprint for this recognition while criticizing the failure of the report to acknowledge the ongoing sweeps of homeless encampments, saying, “Unfortunately, notably absent from this plan is any comment on the Administration's current policy of sweeps and harassment of homeless individuals on New York City streets and subways. I have said that this approach does the last thing first. And without a place for these New Yorkers to go is an inhumane policy that continues the conflation of fixing the homelessness crisis with not seeing homeless people in specific areas. The starting point to end homelessness is to ensure every interaction between an unhoused person in this city and a representative of this government is respectful and culturally sensitive.”
