Two Men Charged In Connection With 11 Robberies And Attempted Robberies Of Luxury Watches In New York City, New Jersey, And Long Island

 

      Audrey Strauss, the United States Attorney for the Southern District of New York, and Dermot Shea, Police Commissioner for the City of New York (“NYPD”), announced the unsealing of a Superseding Indictment charging VICTOR RIVERA, 30, and JOHAN ARAUJO, 40, with conspiracy to commit robbery, robbery, attempted robbery, attempted extortion, interstate transportation of stolen property, money laundering, and firearms offenses.  ARAUJO was arrested on July 23 and presented and arraigned before United States Magistrate Judge Katharine H. Parker.  RIVERA was previously charged in an Indictment in November 2020 and is currently in custody.  This case is assigned to United States District Judge Alvin K. Hellerstein.           

U.S. Attorney Audrey Strauss said: “As alleged in the Indictment, the defendants committed a series of armed robberies and attempted robberies of jewelers and other owners of luxury watches in and around New York City.  In one of these robberies, a victim was shot.  Thanks to the outstanding work of the NYPD and Special Agents of our Office, time ran out on the defendants, who now face federal charges for their alleged crimes.”

NYPD Commissioner Dermot Shea said: “The charges show that while criminals often believe they can operate in plain sight with apparent impunity, the NYPD and our law enforcement partners exist to shatter that notion and bring those responsible to justice.  I thank our colleagues at the United States Attorney’s Office in the Southern District of New York for their dedication and hard work building this case and ensuring these two alleged dangerous criminals will be held to account.”

As alleged in the Indictment unsealed last Friday in Manhattan federal court and based on statements made in court proceedings and filings[1]:

From at least in or about October 2019 up to and including November 2020, RIVERA, ARAUJO, and others known and unknown agreed to rob victims of luxury watches worth up to hundreds of thousands of dollars each.  The watches owned by victims targeted in the robberies included Richard Mille, Rolex, Audemars Piguet, and Patek Philippe as part of the jewelers’ businesses based in Manhattan’s Diamond District.  RIVERA used guns to commit several of the robberies, and in one robbery, shot a victim, who survived. 

The 11 robberies and attempted robberies included the following: 

1. On October 3, 2019, RIVERA and a co-conspirator robbed a jeweler in Long Island City, New York, of, among other things, a Richard Mille watch worth over $250,000.
2. On October 25, 2019, RIVERA and a co-conspirator robbed a jeweler in Jamaica, New York, of, among other things, a Rolex watch worth over $150,000.
3. On December 10, 2019, RIVERA, ARAUJO, and a co-conspirator robbed a jeweler in Brooklyn, New York, of, among other things, a Patek Philippe watch worth over $160,000 and a diamond necklace worth over $77,000.  During the robbery, a firearm was shown to the victim.
4. On January 14, 2020, RIVERA and a co-conspirator robbed of a jeweler in Rego Park, New York, of, among other things, a Richard Mille watch worth over $500,000.
5. On February 16, 2020, RIVERA and ARAUJO robbed a jeweler in Jamaica Estates, New York, of, among other things, an Audemars Piguet watch worth over $28,000.
6. On February 20, 2020, RIVERA and a co-conspirator robbed an individual in Long Island City, New York, of, among other things, an Audemars Piguet watch worth over $125,000.
7. On June 11, 2020, RIVERA and ARAUJO robbed a jeweler in Brooklyn, New York, of, among other things, a Richard Mille watch worth over $148,000.  During the robbery, a firearm was shown to the victim and a victim was shot.
8. On July 6, 2020, RIVERA and a co-conspirator robbed a jeweler in Hoboken, New Jersey, of, among other things, a Richard Mille watch worth over $81,000.  Following the robbery, RIVERA and others transported the stolen watch from New Jersey to New York.
9. On July 20, 2020, RIVERA and a co-conspirator participated in an attempted robbery of a jeweler in Queens, New York, attempting to steal a Richard Mille watch worth over $180,000.
10. On August 2, 2020, RIVERA and a co-conspirator robbed an individual in the vicinity of Englewood Cliffs, New Jersey, of, among other things, a Richard Mille watch worth over $250,000.  During the robbery, a firearm was shown to a victim.  Following the robbery, RIVERA and others transported the stolen watch from New Jersey to New York.
11. On October 27, 2020, RIVERA and a co-conspirator robbed a jeweler in the vicinity of Woodbury, New York, of, among other things, an Audemars Piguet watch worth over $26,000 and assorted jewels and gold links worth over $60,000.  During the robbery, a firearm was shown to a victim.           

A chart containing the names, charges, and maximum and minimum penalties for the defendants is set forth below.  The maximum potential sentences in this case are prescribed by Congress and are provided here for informational purposes only, as any sentencing of the defendants will be determined by the judge.

Ms. Strauss praised the outstanding investigative work of the New York City Police Department and the Special Agents of the U.S. Attorney’s Office for the Southern District of New York.  Ms. Strauss also thanked the Bergen County Prosecutor’s Office, the Englewood Cliffs Police Department, the Weehawken Police Department, and the Nassau County Police Department for their assistance.

This case is being handled by the Office’s Violent and Organized Crime Unit.  Assistant United States Attorneys Mathew Andrews, Andrew K. Chan, and Celia Cohen are in charge of the prosecution.           

The charges contained in the Indictment are merely accusations, and the defendants are presumed innocent unless and until proven guilty.

RECOVERY FOR ALL OF US: CITY FINANCES MOST NEW CONSTRUCTION OF AFFORDABLE HOUSING EVER. Mayor cuts ribbon at Bronx Commons 305 units of affordable housing

 Mayor Bill de Blasio joined Deputy Mayor Vicki Been, the New York City Department of Housing Preservation (HPD) and the New York City Housing Development Corporation (HDC) to announce that New York City secured 28,310 affordable homes through new construction and preservation deals in Fiscal Year 2021 (FY21). That figure includes a record-breaking 11,322 new affordable homes, 64% of which are affordable for families of three earning less than $53,000. The City also created nearly 3,300 units for seniors, and nearly 2,800 units formerly homeless New Yorkers – both records for this administration. To commemorate a milestone year, the Mayor visited Bronx Commons, a 305-unit affordable housing development that combines deeply affordable housing with a dynamic new music hall, pre-school, and other retail and recreational space.

“By the end of this administration, we will reach 200,000 affordable apartments for the people of New York City,” said Mayor Bill de Blasio, the number is currently at 194,000 units of affordable housing. We have fought tirelessly to bring New Yorkers the safe, healthy, and affordable homes they deserve,  said Vicky Been Deputy Mayor for Housing and Economic Development. Bronx Commons’ development team includes non-profit WHEDco and BFC. WHEDco also manages the cultural centerpiece of the development, the Bronx Music Hall, which will showcase the Bronx’s music history and catalyzes economic development in the community. The development also includes a 428-panel rooftop Solar PV installation, one of the largest on an affordable housing development in New York City. The Bronx leads all boroughs with 66,204 units of affordable housing since Mayor de Blasio became mayor in 2014. The next highest borough is Brooklyn with 49,926. 

Councilman Rafael Salamanca welcomed Bronx Commons, adding that his council district has the most affordable housing under the de Blasio Administration.

Deputy Mayor Vicky Been speaks of the achievement of the de Blasio administration to meet its goal of 200,000 new or reconditioned affordable housing units during Mayor de Blasio's eight years in office.

Mayor Bill de Blasio says that his administration has only 6,000 more units of affordable housing to go to meet his goal of 200,000 units of affordable housing in his eight years in office. 

Mayor de Blasio cuts the ribbon to officially open Bronx Commons, which includes a 260 seat music hall that can be used for other events, a gym, and 150 seat Pre-K.  

Governor Cuomo Announces Streamlined Application Process for Rent Relief Program

 

New Process Immediately Relaxes Documentation Standards for Both Tenants and Landlords

Over 1,000 Dedicated Staff and 350 Volunteers Will Help Clear Pending Cases

 Governor Andrew M. Cuomo today announced a new streamlined application process for New York's rent relief program to help eliminate potential barriers for eligible New Yorkers to receive funding. The new process immediately relaxes documentation standards for both tenants and landlords and implements a streamlined process for submission of arrears documentation for multi-tenant landlords effective tomorrow, July 27. With these new processes in place, the New York State Office of Temporary and Disability Assistance will be able to establish a number of viable applications out of the total of over 150,000 submitted by August 7.

Additionally, the contracted vendor working with the State on the rent relief program now has over 1,000 staff dedicated to this effort and will be onboarding additional accounting experts. The NYS Office of Temporary and Disability Assistance will also onboard a minimum of 350 State staff volunteers from other agencies starting today to clear the pending 4,828 cases reviewed and verified applications for payment by August 3. By August 31, OTDA will be current with payment for all pending, verified applications.

"The COVID pandemic has taken a tremendous toll on New Yorkers all across the State, and they need rental assistance now," Governor Cuomo said. "The $2.7 billion Rental Assistance Program is already providing funding to some of our most vulnerable residents who were prioritized during the first 30 days of the application process, and now we must focus on delivering funds to the remaining applicants. To streamline this process, I've directed OTDA to work with their vendor to disburse payments as quickly and efficiently as possible we can deliver billions of dollars in rental assistance to New Yorkers who have been struggling to pay rent due to no fault of their own."

New York State's rental assistance program makes up to $2.7 billion in emergency rental assistance available for struggling New Yorkers impacted by the COVID-19 pandemic. The program assists households behind on their rent and that have experienced financial hardship, that are at risk of homelessness or housing instability and that earn at or below 80 percent of area median income. Administered by the state Office of Temporary and Disability Assistance, the New York State Emergency Rental Assistance Program provides assistance with up to 12 months of past-due rent, 3 months of prospective rental assistance and 12 months of utility arrears payments to eligible New Yorkers, regardless of immigration status. The program is expected to serve between 170,000 and 200,000 households.

In addition to fiscal relief, ERAP provides significant tenant protections. In order to receive assistance, the landlord must agree to waive any late fees due on past-due rent; and not increase the tenant's monthly rent or evict them for one year, except in limited circumstances.

The program is funded by $2.6 billion in federal resources and $100 million of state funding and is structured to help the state and the local governments that received funds directly from the federal government to collaborate and coordinate their efforts, thereby leveraging resources, gaining efficiencies and preventing fraud.

OTDA has organized an unprecedented effort to establish partnerships with local governments across the state to ensure that community-based organizations will provide outreach and direct application assistance in multiple languages to potential recipients. This effort mobilizes substantial resources in order to ensure tenants from all across the state are aware of ERAP and able to apply.

In addition, the agency is undertaking fraud prevention efforts to identify unreported income and to prevent duplicate rental payments.

Seven communities that received funding for emergency rental assistance directly from the federal government opted to administer their own programs. Residents of the City of Rochester and Monroe County, the City of Yonkers, Onondaga County and the towns of Hempstead, Islip and Oyster Bay must apply with their local programs for emergency rental assistance and are ineligible for assistance from the state-administered Emergency Rental Assistance Program. The $2.7 billion program includes the $168 million provided directly to these localities.

“If City Hall intends to test our members weekly, they must first meet us at the table to bargain. While we encourage everyone to get vaccinated and support measures to ensure our members’ health and wellbeing, weekly testing is clearly subject to mandatory bargaining. New York City is a union town and that cannot be ignored.”

HEALTH DEPARTMENT TO CONDUCT MOSQUITO ADULTICIDING IN THE BRONX TO REDUCE RISK OF WEST NILE VIRUS IN COMMUNITY BOARD 10 AND 11 AREAS

 

Trucks will spray pesticide in parts of the Bronx in the evening of Monday, July 26

 To reduce mosquito activity and the risk of West Nile virus, the Health Department will conduct an adulticide treatment in the Bronx. Trucks will spray pesticides in sections of the Bronx on Monday, July 26, between the hours of 8:30 p.m. and 6 a.m. the following morning, weather permitting. In case of bad weather or equipment malfunctions, application will be delayed until Tuesday, July 27.

 The Health Department will use very low concentrations of Anvil®. The risks of pesticides applied by the Health Department for mosquito control are low to people and pets. Some people who are sensitive to spray ingredients may experience short-term eye or throat irritation, or a rash. People with respiratory conditions may also be affected.

 To stay safe during spraying:

• Stay indoors, whenever possible.

• Air conditioners can remain on. While unnecessary, you may wish to close air conditioner vents, or choose the recirculate function.

After spraying:

• Wash skin and clothing exposed to pesticides with soap and water.

• Always wash fruits and vegetables with water.

 The most effective way to control mosquitoes is to eliminate any standing water. New Yorkers are also encouraged to mosquito-proof their homes and take precautions when spending time outdoors.

Reducing exposure to mosquitoes

• Use an approved insect repellent containing DEET, picaridin, oil of lemon eucalyptus (not for children under 3), or products that contain the active ingredient IR3535.

• Make sure windows have screens. Repair or replace screens that have tears or holes.

• Eliminate any standing water from your property and dispose of containers that can collect water. Standing water is a violation of the New York City Health Code.

• Make sure roof gutters are clean and draining properly.

• Clean and chlorinate swimming pools, outdoor saunas and hot tubs. Keep them empty or covered if not in use. Drain water that collects in pool covers.
